Is Delta 8 THC Legal in Wyoming?
Yes, hemp-derived delta 8 THC is legal in Wyoming.
Wyoming hasn’t explicitly banned the distribution and sale of hemp-derived delta 8 THC products. After the Hemp Farming Act was enacted, Wyoming updated its hemp laws to legalize hemp and hemp products, including cannabidiol (CBD).
HB 171 legalized the sale of the hemp plant and its derivatives, extracts, cannabinoids, isomers, acids, salts or salts of isomers with a THC concentration of less than 0.3%. You need to be 18 or older to purchase vaping and edible THC products under HB 108.
After the 2018 Farm Bill was enacted, the state updated its Controlled Substances Act. In it, they exclude the possession of hemp and hemp products from scheduling. They state that the provisions and penalties included in the “control of substances” chapter don’t apply to “the possession or use of hemp or hemp products for any purpose or application.”
This means that hemp-derived delta 8 THC is not a Controlled Substance in Wyoming. There’s a draft bill proposed in September 2023 that could add delta 8 THC to Schedule I, so things may change quickly for this cannabinoid.

Where to Buy Delta 8 THC in Wyoming?
You can probably find a range of D8 products at local Wyoming shops. Still the best option is to order delta 8 THC products online. Unlicensed outlets like convenience stores, gas stations, and bodegas may sell a range of cheap, untested D8 products.
Each item comes with a Certificate of Analysis issued by a third-party testing lab. The labs are displayed on the product page, and we’re always open to more questions about the origin and extraction of the material. If the supplier doesn’t provide detailed and truthful answers to your questions about product quality screening, consider it a huge red flag.
A report on D8 THC products revealed that a large number of them are mislabeled. The report also showed that the products were infused with a proportionally higher or lower concentration of D8 than advertised. This is why it’s important to shop at a reliable supplier that performs quality screening.
What is Delta 8 THC?
You might’ve heard about D8 THC as “the other” type of THC that relieves pain or anxiety while getting you mildly intoxicated. Research shows that delta 8 THC is roughly 50 to 70 percent less potent than delta 9 THC.
Consumers prefer it over high-THC cannabis because it gives them a mild but energetic “intoxication.” In some people, it may cause improved focus as a result of lowered anxiety levels, while in others, it can act as an effective sleep aid.
Delta 8 THC and Federal Law
The legality of delta 8 THC on a federal level is complicated.
In August 2020, the Drug Enforcement Administration (DEA) released an Interim Rule addressing the implementation of the Hemp Farming Act. In it, they stated that the Hemp Farming Act doesn’t impact the control status of synthetically derived tetrahydrocannabinol because the statutory definition of ‘hemp’ is limited to materials that are derived from Cannabis sativa L.”
As you can imagine, this statement brought a mountain of questions and general confusion about the legal status of D8 THC. The main source of confusion is the very origin of this cannabinoid because most products on the market are infused with D8 THC converted from hemp-derived cannabidiol (CBD) in a lab.
Federal law doesn’t explicitly define the term “synthetic,” which leaves space for debate whether CBD-derived delta 8 is a “synthetic THC.” Most experts agree that this compound doesn’t quite fit the description of typical synthetic THCs like Spice and K2. Not only are they dangerous and potentially life-threatening, but they are made in a lab with no involvement of hemp material whatsoever.
Delta 8, on the other hand, is made from an organically extracted source — hemp-derived CBD. It’s important to note that this loophole gives the DEA space to consider hemp-derived D8 a synthetic cannabinoid. Given the DEA’s hostility towards cannabis, it’s very likely that they will keep the same stance in the Final Rule. But for now, the legality of D8 THC on a federal level remains in limbo.
