Often described as “cannabis-light” or “diet-cannabis,” Delta-8 THC is a newly popular hemp cannabinoid that’s being sold thanks to a legal loophole. Despite being marketed only as a “lighter” form of cannabis, the benefits of Delta-8 THC are the main reason behind its popularity. Is D-8 THC legal in Wyoming? If so, where to buy it?

Do you live in Wyoming and want some Delta-8 shipped to your door?

Is It Legal: Wyoming Delta-8 Laws

The short and simple answer is: YES! Hemp-derived Delta-8 is likely LEGAL in Wyoming.

What Is Delta-8?

You might’ve heard about D-8 THC as “the other” type of THC that relieves pain or anxiety while getting you mildly intoxicated. Research shows that Delta-8 THC is roughly 50 to 70 percent less potent than Delta-9 THC.

The National Cancer Institute defines D-8 as a compound that exhibits neuroprotective properties and could help with nausea and vomiting, anxiety, pain, and decreased appetite. Consumers prefer it over high-THC cannabis because it gives them a mild but energetic “high.” In some people, it may cause improved focus as a result of lowered anxiety levels, while in others, it can act as an effective sleep aid.

Where to Buy Delta-8 in Wyoming

You can probably find a range of D-8 products at local Wyoming shops. Unlicensed outlets like convenience stores, gas stations, and bodegas may sell a range of cheap, untested D-8 products. Because the market is highly unregulated, the safest option is to order D-8 products online.

But, before you do that, make sure to check the supplier and the products they’re selling. The first thing to look for when buying D-8 products is lab results. At Mr. Hemp Flower, we offer a range of high-quality Delta-8 THC products, including Delta-8 THC gummies, concentrates, soft gel capsules, hemp flower, D-8 pre-rolls

Each item comes with a Certificate of Analysis issued by a third-party testing lab. The labs are displayed on the product page, and we’re always open to more questions about the origin and extraction of the material. If the supplier doesn’t provide detailed and truthful answers to your questions about product quality screening, consider it a huge red flag.

A recent report on D-8 THC products revealed that a large number of them are mislabeled. Most products contained higher levels of Delta-9 THC than allowed with the Hemp Farming Act. Delta-9 is a prohibited marijuana compound in many states (Wyoming included), and a product like that could get you into legal trouble.

The report also showed that the products were infused with a proportionally higher or lower concentration of D-8 than advertised. This is why it’s important to shop at a reliable supplier that performs quality screening.

Continued, Is Delta-8 Legal in Wyoming?

YES, hemp-derived Delta-8 THC is LEGAL in Wyoming.

After the Hemp Farming Act was enacted, Wyoming quickly updated its hemp laws to legalize hemp and hemp products, including cannabidiol (CBD). The new law legalized the sale of the hemp plant and its derivatives, extracts, cannabinoids, isomers, acids, salts or salts of isomers with a THC concentration of less than 0.3%.

The state has some of the strictest cannabis laws in the nation. This is one of the main reasons you should always check the source of the product you’re purchasing. Try to stick to hemp companies like Mr. Hemp Flower that use legal material to make their products and perform quality testing.

Wyoming hasn’t explicitly banned the distribution and sale of hemp-derived D-8 THC products.

After the passage of the 2018 Farm BIll, the state updated its Controlled Substances Act. In it, they exclude possession of hemp and hemp products from scheduling. They state that the provisions and penalties included in the “control of substances” chapter don’t apply to “the possession or use of hemp or hemp products for any purpose or application.”

This means that hemp-derived Delta-8 is not a Controlled Substance in Wyoming.

Delta-8 THC and Federal Law

The legality of Delta-8 THC on a federal level is complicated.

In August 2020, the Drug Enforcement Administration (DEA) released an Interim Rule addressing the implementation of the Hemp Farming Act. In it, they stated that the Hemp Farming Act doesn’t impact the control status of synthetically derived tetrahydrocannabinol because the statutory definition of ‘hemp’ is limited to materials that are derived from Cannabis sativa L.”

As you can imagine, this statement brought a mountain of questions and general confusion about the legal status of D-8 THC. The main source of confusion is the very origin of this cannabinoid because most products on the market are infused with D-8 THC converted from hemp-derived cannabidiol (CBD) in a lab.

Federal law doesn’t explicitly define the term “synthetic,” which leaves space for debate whether CBD-derived Delta-8 is a “synthetic THC.” Most experts agree that this compound doesn’t quite fit the description of typical synthetic THCs like Spice and K2. Not only are they dangerous and potentially life-threatening, but they are made in a lab with no involvement of hemp material whatsoever.

Delta-8, on the other hand, is made from an organically extracted source hemp-derived CBD. It’s important to note that this loophole gives the DEA space to consider hemp-derived D-8 a synthetic cannabinoid. Given the DEA’s hostility towards cannabis, it’s very likely that they will keep the same stance in the Final Rule. But for now, the legality of D-8 THC on a federal level remains in limbo.

Bottom line

Delta-8 THC is legal to buy in Wyoming. The state hasn’t explicitly banned the manufacture, distribution, and sale of products containing this cannabinoid.
