The state punishes possession of a Schedule IIIA substance as a misdemeanor or a felony, depending on the amount possessed. What is Delta 8 THC?

One of the reasons why people are torn about the legality of D-8 THC on a federal level is the release of the Interim Rule by the Drug Enforcement Administration in August 2020. The report stated that synthetically derived tetrahydrocannabinols remain illegal and that the Hemp Farming Act has no power over such compounds. 

A concern here is that federal law doesn’t provide an exact definition of the term “synthetic.” This leaves space for the DEA to deem D8 THC illegal and for experts to debate whether D8 made from hemp is “synthetically derived” like true synthetic THCs Spice and K2. Until these questions are clarified through laws and regulations, the legality of this cannabinoid remains murky.
