Is Delta 8 THC Legal in Arkansas?

Hemp-derived delta 8 THC is legal in Arkansas, but the state is attempting to regulate it by banning it.

Arkansas has a complicated delta 8 THC legal landscape. A lot has happened, but in summary, the state is trying to regulate this cannabinoid by prohibiting it. The legislators passed Act 629 in April 2023 to prohibit the sale and production of hemp-derived intoxicating substances.

If enacted, the bill would have banned cannabinoids made through a synthetic chemical process, and this includes delta 8, delta 9, and delta 10 THC.

Aside from this ban, the bill redefines hemp to have a total delta 9 THC concentration of less than 0.3% of hemp-derived CBD.

This definition goes against the Farm Bill’s definition of hemp and it’s impossible to follow through with in practice. So, when challenged in court by local companies, the enforcement of this act was prevented.

Until this case is settled in 2024, the sale, use, and possession of delta 8 THC is legal in Arkansas.

What is Delta 8 THC?

Delta 8 tetrahydrocannabinol is a naturally occurring cannabinoid derived from hemp-extracted cannabidiol (CBD). Unlike CBD, this compound is intoxicating. Many consumers have described the D8 high as ‘more functional and alert’ because it eliminates the anxiety and paranoia caused by more energizing high-THC cannabis strains.

The reason behind this might be that D8 is roughly half the potency of the primary THC molecule in cannabis delta 9. Aside from being a mildly intoxicating compound, D8 also exhibits a range of therapeutic benefits. It may help with pain, anxiety, and lack of appetite.

Delta 8 THC and Federal Law

The 2018 Farm Bill legalized the hemp plant and all its cannabinoids, derivatives, extracts, isomers, salts and salts of isomers on a federal level. Under this legislation, delta 8 THC derived from hemp is a legal cannabinoid.

But, because most hemp strains don’t create D8 in enough concentration naturally, its extraction is challenging. So, manufacturers have found a more viable solution to infuse the products with D8 made from hemp-derived cannabidiol (CBD).

Because D8 is synthesized from hemp-CBD as opposed to directly extracted in its organic state, there’s a risk that it may be considered a synthetically derived tetrahydrocannabinol by the Drug Enforcement Administration (DEA). Federal law doesn’t explicitly define the term “synthetic,” which leaves space for debate.

Back in August 2020, the DEA released its Interim Rule on the implementation of the Hemp Farming Act. The report was released during the time when delta 8 started booming. It stated that “all synthetically derived tetrahydrocannabinols remain illegal.”

This prompted a debate on whether D8 made from hemp is a synthetic cannabinoid, and if so, does it fall under the protection of the 2018 Hemp Farming Act. Regarding this issue, the Interim Rule also stated that the Hemp Farming Act holds no power over synthetically derived cannabinoids.

The opinions on this topic are split, with most experts leaning towards its legality. However, until the DEA formally clarifies its position on the matter and the compound is regulated, D8’s legality remains murky.

Final Thoughts

Delta 8 is legal to buy in Arkansas for now. The Natural State passed a bill that prohibits the sale and production of delta 8 THC and other isomers. But, the bill’s enforcement has stalled due to a lawsuit by local companies.
