Act No. 344, effective August 1, 2020, has prohibited the sale of hemp products meant for inhalation. In the updated version, the bill states:

  A. No person shall sell or offer for sale any part of hemp for inhalation except for hemp rolling papers. 

  B. No person shall process, sell, or offer for sale:

   (1) Any alcoholic beverage containing CBD. 

   (2) Any consumable hemp product without a license or permit. 

Note how hemp flower is not banned in Louisiana as long as it’s not marketed for inhalation and comes in odor-proof packaging. The clarification was also given in a webinar held by the Louisiana Department of Health

This is because hemp flower can be used for other purposes, including tinctures, edibles, balms, etc. Because of that, it’s entirely lawful to sell it. The reason behind this may be the potential of placing products for inhalation on another market in another state. 

Louisiana’s law defines “industrial hemp” as:

“The plant Cannabis sativa L. and any part of such plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with no more than the federally defined THC level for hemp.”

In summary, it’s completely legal to buy hemp flower in Louisiana. The amount of delta 9 THC in hemp flower must not exceed 0.3% on a dry weight basis. The updated bill allows hemp flower to contain a total THC concentration of up to 1% on a dry-weight basis.
