In March 2021, the Oregon Liquor Control Commission initiated rule-making for D8 and other psychoactive components of hemp and marijuana that fall outside the state’s cannabis system of labeling and testing. This cannabinoid isn’t addressed in Oregon statutes or marijuana concentration limits. The state doesn’t test for the component or by-products included in its chemical conversion. 

In the proposed rule-making, state regulators would address the presence of D8 and other artificially-derived cannabinoids in products manufactured and sold within the state’s marijuana program. The Oregon Liquor Control Commission doesn’t regulate hemp manufacturing but wants to make sure D8 products are tested for safety. 

Delta-8 THC and Federal Law 

We all know that the 2018 Farm Bill legalized all hemp-derived cannabinoids, including Delta-8 THC. This component is organically present in the hemp plant in less than 0.1%, which is not sufficient for manufacturers to extract it. 

So, they use hemp-derived CBD to convert it into D8 with the process of isomerization. This process creates a potential conflict with a regulation of the Drug Enforcement Agency (DEA) because when isomerized, D8 may be considered a synthetically-derived tetrahydrocannabinol. Namely, DEA’s Interim Rule groups all synthetically derived tetrahydrocannabinol, a Schedule I controlled substance.

The ongoing debate is whether Delta-8 THC made using the method of isomerization (conversion of one cannabinoid into another) is considered a “synthetic” drug.    

For the time being, Oregon’s lawmakers are at the forefront of regulating Delta-8 THC products. It appears that they’re not looking to ban the compound but ensure that the products that hit the market are safe to consume.  

Oregon is one of the more lax states when it comes to CBD regulations. Businesses selling CBD in Oregon don’t need to apply for a license or register to sell these products as long as they meet federal regulations. Therefore, hemp CBD products that contain less than 0.3% THC and aren’t advertised as dietary supplements are legal to buy without age restrictions.
