Yes, hemp-derived Delta-8 THC is legal in Georgia. 

In May 2019, Georgia legalized hemp and all derivatives, extracts, cannabinoids, and isomers so long as the plant has no more than 0.3% Delta-9 THC by dry weight basis. Like California, Georgia aligns with federal law when it comes to using cannabinoids like hemp-derived CBD in products for human consumption. 

This means that the types of products that can be legally sold in the state are limited. The Georgia Department of Agriculture prohibits the sale of CBD in food, drink, and as a dietary supplement. 

So far, Georgia hasn’t taken steps to explicitly prohibit the sale and use of Delta-8 products. Therefore, hemp-derived D8 made from legally cultivated hemp with a Delta-9 concentration of less than 0.3% is legal in this state.

But, it’s important to keep in mind that Georgia’s hemp laws are much stricter than the laws of other states. The state has no possession limits on hemp-derived CBD products so long as they contain less than 0.3% THC by weight.   

Delta-8 THC and Federal Law 

On a federal level, Delta-8’s legality remains sticky. The 2018 Farm Bill legalized all hemp cannabinoids, including D8, that’s naturally present in the hemp plant. Therefore, hemp and hemp-derived products with 0.3% THC or less are legal in the country. 

D8 is naturally present in most hemp strains in a small concentration of less than 0.1%. Because it occurs in such low concentrations, manufacturers can’t extract it directly and infuse it into products like gummies, tinctures, and capsules. So, they’ve found a way to synthesize it from other cannabinoids. 

Most D8 products on the market are made with D8 that’s been synthesized from hemp-derived CBD. And this process of chemically altering one cannabinoid to make a tetrahydrocannabinol is where the issue arises. Federal law outlaws the production of “synthetically derived THC” as per the 1986 Federal Analogue Act. The Act banned THC like Spice and K2, which are made in the lab without any involvement of cannabis plant material. 

Also, the 2020 Interim Rule released by the Drug Enforcement Administration (DEA) “confirms” that synthetically made THC remains a Schedule I Controlled Substance. The rule defines “synthetically derived THC” broadly, which allows the DEA to treat CBD-derived Delta-8 as a “synthetically derived” THC and a controlled substance. 

D8 products for human consumption also fall under the Food and Drug Administration (FDA) regulations, as per the 2018 Farm Bill. Like hemp-derived CBD products for human consumption, D8 products need pre-market approval from the FDA. 

It’s more than obvious that Delta-8 requires a separate regulatory framework. For the time being, the legal status of this derivative on a federal level remains unclear.
