Under Article 39 of the Kansas Hemp Statues, the following hemp products are unlawful and must not be manufactured, marketed or sold to any person in Kansas:

  • Teas containing industrial hemp;

  • Any other hemp product intended for human or animal consumption containing any ingredient derived from industrial hemp that is prohibited pursuant to the Kansas Food, Drug and Cosmetic Act.

Hemp flower is legal in Kansas but can only be sold, distributed, or marketed by a hemp processor licensed under the commercial state plan. Under Article 39 of the Kansas Hemp Statutes, such products are:

  • Ground industrial hemp floral material

  • Any extract from industrial hemp with a delta-9-tetrahydrocannabinol concentration greater than 0.3% that will be further processed.
