After the 2018 Agricultural Improvement Act, Ohio legalized hemp and all hemp derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers with a Delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent. 

The Buckeye State amended the definition of “tetrahydrocannabinols” under the Controlled Substances Act and excluded “tetrahydrocannabinols found in hemp” and “hemp products” from the definition of THC. 

Ohio has yet to introduce legislation that would regulate hemp-derived tetrahydrocannabinols. The state enacted a set of regulations on Delta-8 THC (and other THC isomers like Delta-10 THC) within its medical marijuana program, but they don’t have a direct impact on the sales outside Ohio’s Medical Marijuana Control Program.     

Changes Regarding Medical Cannabis Products

The state recently made changes to its medical marijuana program regarding the sale of Delta-8 THC and other THC isomers. On June 15, the Ohio Department of Commerce released a set of regulations on Delta-8 THC in medical marijuana products. 

Before these regulations, producers and testing labs didn’t have to state the Delta-8 THC content on the label. The new guidance declares that manufacturers and testing labs must list the exact amount of Delta-8 THC on the product label. 

The state also capped the levels of the THC content in medical cannabis products to 70 percent. The total THC content includes Delta-9 THC and any other THC isomers, including Delta-8 and Delta-10.

Delta-10 THC and Federal Law 

As an intoxicating hemp-derived tetrahydrocannabinol, Delta-10’s legality on federal and state levels is gray. This cannabinoid is a real THC isomer that belongs to the minor group of compounds present in the plant that scientists could barely trace and recognize.
