Is Delta-10 THC Banned in Oregon? An Explanation of the Legal Complexities

Delta 10 Oregon

Move over Delta-8 THC. The world is getting familiar with another cannabinoid, Delta-10 THC. Products containing this compound are finding their way to convenience stores and dispensaries around Oregon and beyond. If you live in the Beaver State and want to try this compound, you’re probably wondering whether it’s legal. Has Oregon restricted the sale of hemp THC products? Let’s look at the laws and regulations.

Is It Legal: Oregon Delta-10 THC Laws

The short and simple answer is

YES

Delta-10 THC is LEGAL in Oregon.

What Is Delta-10 THC?

Delta-10 tetrahydrocannabinol (D-10 THC) is a recently discovered hemp cannabinoid with intoxicating properties. This compound is hard to trace in the cannabis plant because it exists in its early stages of growth. So, chemists use hemp-derived cannabidiol (CBD) to synthesize it in a lab. We don’t have any scientific evidence on the beneficial properties of Delta-10 THC.

Anecdotal reports show that this substance is psychotropic but less than Delta-9 THC. It acts like a mood enhancer that boosts energy levels and creativity, so it’s close to the effects of sativa cannabis strains. The substance is similar in potency to Delta-8 THC but stands on the opposite side in terms of features. Delta-8’s mellow and relaxing properties are compared to indica strains.

Continued, Is Delta-10 THC Legal in Oregon?

Hemp-derived Delta-8 THC and other THC isomers derived from hemp (like Delta-10 THC) are legal in Oregon.

But, the Beaver State is currently considering legislative restrictions for hemp-derived products, including Delta-8 and Delta-10. A bill that’s going to immediately ban the sale of hemp products containing tetrahydrocannabinol (THC) to minors is awaiting signature by Gov. Brown.

If approved, the bill would grant authority to the Oregon Liquor Control Commission and the Oregon Department of Agriculture to restrict the THC concentration for hemp products sold in retail. It would allow them to set potency limits on artificial cannabinoids and clarify testing requirements for consumable products.

The bill defines artificially derived cannabinoids, adult-use cannabis, Delta-9 THC, and total Delta-9 THC levels. The main goal of the restrictions is to protect minors and communities from harmful hemp-derived THC goods.

In short, Delta-8 and Delta-10 will remain legal in Oregon but will be subject to regulations and therefore sold as part of the adult-use, legal cannabis system if they exceed the levels of THC established by the commission.

Oregon laws broadly legalize hemp and its compounds. The law makes a distinction between hemp and marijuana and excludes hemp from the list of controlled substances. In 1998, the Beaver State became the first state to legalize the use of medical cannabis. Recreational sales of marijuana became legal in the state in 2014.

Delta-10 THC and Federal Law

Many complexities surround the legality of Delta-10 THC and federal law mainly because of the way this compound is manufactured.

The recent discovery and market placement of Delta-10 THC brought a surge of questions surrounding its legality. Some experts claim the compound is legal under the 2018 Farm Bill because it’s technically derived from hemp CBD. Others take a stricter approach and claim that it’s illegal because it falls in the category of synthetically derived tetrahydrocannabinols.

A lot can be said about this compound because it is made in a lab, which makes it semi-synthetic. But, it’s also derived from hemp cannabidiol (CBD), which differentiates it from true “synthetically derived” tetrahydrocannabinols.

The Interim Rule issued by the U.S. Drug Enforcement Administration (“DEA”) confirmed the illegal status of “synthetically derived tetrahydrocannabinols.” Cannabinoids like Delta-8 THC are also banned in the Orange Book of approved drug products by the FDA. But, none of these reports officially define or prohibit the use of hemp tetrahydrocannabinols like Delta-10.

Currently, the DEA is working on the Final Rule that will contain answers regarding the implementation of the 2018 Farm Bill and these tetrahydrocannabinols. Until then, this compound remains in the grayest legal area of hemp laws.

Bottom line

Oregon doesn’t explicitly prohibit the distribution and sale of hemp-derived Delta-8 and Delta-10 THC products. As of this writing (07/16/2021), this substance is LEGAL to buy in the Beaver State. But, Oregon is in the process of passing a bill that would ban the sale of high-THC hemp products to minors.
