The situation is a bit more complicated federally because of the federal Controlled Substances Act and the Interim Rule issued in late August 2020. It’s no secret that the Agricultural Improvement Act (2018 Farm Bill) legalized the hemp plant and its cannabinoids and derivatives (except Delta-9 THC) because of their non-intoxicating nature. 

Yet, there’s a discrepancy between science and law regarding cannabis because of its multifaceted nature. The law didn’t exactly consider minor cannabinoids like Delta-8 and Delta-10 that naturally occur in the plant in trace amounts. It even excluded “hemp tetrahydrocannabinols” from the list of controlled substances. The main reason behind it? These cannabinoids occur in such minuscule amounts, which makes extraction extremely challenging. 

To create Delta-10 THC, scientists heavily process hemp-derived cannabidiol (CBD) with the use of catalysts. The process is known as chemical synthesis (the artificial execution of useful chemical reactions to get a new product) and creates a semi-synthetic D-10 THC. According to the Interim Rule, “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.” 

However, because it’s a real tetrahydrocannabinol, D-10 THC is far from artificial, synthetic THCs like Spice and K2. The only thing that could contribute to it being labeled “synthetic” is the way it’s manufactured. As of this writing, the industry is eagerly waiting for the release of the final verdict in the Interim Final Rule by the DEA.
