Delta 10 Texas

Delta-10 THC is the newest cannabinoid filling the shelves of Texas stores. This cannabinoid is similar in potency to Delta-8 THC but offers an entirely new experience for the user. Despite its popularity in this state, one cannot help but wonder: Is Delta-10 THC legal in Texas? Can you order it online? Let’s look at the current laws & regulations of hemp tetrahydrocannabinols in Texas.

Is It Legal: Texas Delta-10 THC Laws

The short and simple answer is: YES! Delta-10 THC is LEGAL in Texas.

What Is Delta-10 THC?

Delta-10 tetrahydrocannabinol (D-10 THC) is the newest hemp derivative on the market, typically made from cannabidiol (CBD). This minor compound belongs to the group of over 100 naturally occurring hemp molecules known as cannabinoids.

D-10 THC is present in the hemp plant in trace amounts and produces a mild, uplifting buzz that increases focus and energy. Perfect for creative, productive work, the effects of this compound lean more towards sativa cannabis strains. According to a 1980s pigeon study, D-10 THC exhibits way milder psychotropic properties than Delta-9 THC.

Continued, Is Delta-10 THC Legal in Texas?

Texas hasn’t expressly banned the manufacture and sale of hemp-derived Delta-10 THC products.

The state doesn’t outlaw Delta-8, Delta-10 THC, and other hemp derivatives, which makes them perfectly legal in Texas. Under federal law, this cannabinoid is legal in Texas if derived from hemp with less than 0.3% Delta-9 THC. If made from marijuana, it’s illegal.

The Lone State State had a failed attempt to prohibit D-8 and similar THC isomers. State Legislatures attempted to pass House Bill 2593, which was going to limit the quantity of THC in all products to 0.3 percent.

Luckily, this bill failed to pass, so you can purchase, possess, and use hemp-derived D-8 products without any trouble from Texas law enforcement. If labeled as a synthetic variant of THC, D-8 and D-10 THC could be outlawed and considered illegal on both federal and state level.

Texas has yet to introduce legislation that would regulate hemp-derived tetrahydrocannabinols. The state legalized the hemp plant right after the passage of the 2018 Farm Bill. The Lone Star State legalized all hemp derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers with a THC concentration of less than 0.3 percent.

Texas also amended its Controlled Substances Act and removed “hemp” and “hemp tetrahydrocannabinols” from the definition of “marijuana” and list of controlled substances.

Delta-10 THC and Federal Law

The Delta-10 THC and Delta-8 THC market is legal but fairly unregulated in Texas. But what about federally? Is this compound legal under federal law? Let’s look at this issue more closely.

The situation is a bit more complicated federally because of the federal Controlled Substances Act and the Interim Rule issued in late August 2020. It’s no secret that the Agricultural Improvement Act (2018 Farm Bill) legalized the hemp plant and its cannabinoids and derivatives (except Delta-9 THC) because of their non-intoxicating nature.

Yet, there’s a discrepancy between science and law regarding cannabis because of its multifaceted nature. The law didn’t exactly consider minor cannabinoids like Delta-8 and Delta-10 that naturally occur in the plant in trace amounts. It even excluded “hemp tetrahydrocannabinols” from the list of controlled substances. The main reason behind it? These cannabinoids occur in such minuscule amounts, which makes extraction extremely challenging.

To create Delta-10 THC, scientists heavily process hemp-derived cannabidiol (CBD) with the use of catalysts. The process is known as chemical synthesis (the artificial execution of useful chemical reactions to get a new product) and creates a semi-synthetic D-10 THC. According to the Interim Rule, “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.”

However, because it’s a real tetrahydrocannabinol, D-10 THC is far from artificial, synthetic THCs like Spice and K2. The only thing that could contribute to it being labeled “synthetic” is the way it’s manufactured. As of this writing, the industry is eagerly waiting for the release of the final verdict in the Interim Final Rule by the DEA.

Bottom line

Texas hasn’t expressly banned the manufacture, distribution, and sale of hemp-derived Delta-10 THC. For now, products containing D-10 THC are legal to buy in the Lone Star State. The best place to get high-quality D-10 THC products is reputable online brands like Mr. Hemp Flower.
