Delta 10 South Dakota

Delta-10 THC is the new cannabinoid in the spotlight that will enhance your mood and uplift your energy. Perfect for daytime use, the effects of this hemp-derived cannabinoid resemble sativa cannabis strains. But is it legal in South Dakota? If so, where to buy it? Let’s look at the current laws & regulations of hemp tetrahydrocannabinols in South Dakota.

Is It Legal: South Dakota Delta-10 THC Laws

The short and simple answer is: YES! Delta-10 THC is LEGAL in South Dakota.

What Is Delta-10 THC?

Delta-10 tetrahydrocannabinol (D-10 THC) is another type of THC isomer that can be derived from hemp or marijuana. This minor compound is present in the hemp plant in minuscule amounts and produces a milder high than Delta-8 THC. Regarding effects, this cannabinoid is more uplifting, heightens focus, improves creativity and boosts energy features attributed to sativa cannabis strains.

As a THC isomer (together with Delta-8 and Delta-9 THC), this cannabinoid influences the endocannabinoid system (ECS) and its receptors — particularly the CB1 receptors located in the brain. As you may know, this receptor group is “in charge” of producing the intoxicating properties when binding to the THC molecule. According to a 1980s animal study, D-10 THC has milder psychotropic properties compared to Delta-9 THC.

Buy Delta-10 THC in South Dakota NOW

The best place to buy Delta-10 THC in South Dakota is online, from reputable hemp CBD and Delta-8 stores. If the store has been selling top-shelf D-8 THC products, they are very likely to offer quality D-10 THC as well. Mr. Hemp Flower is a trusted brand that offers genuine Delta-10 THC concentrate.

Our D-10 THC Vape Cart contains up to 60% potent D-10 THC and allows you to enjoy the flavor and experience of genuine D-10 concentrate. We also offer a wide selection of premium Delta-8 THC and full spectrum CBD products. Each item is tested for safety and potency and comes with a Certificate of Analysis. Our team strives to create high-quality products that actually work. We are aware that the market is full of brands offering fake, poor-quality products with zero effectiveness that can even be harmful to the body.

Each cannabinoid has its distinctive properties, so you should carefully consider the item you’re buying. Unlike D-8 THC that relaxes the body in a more soothing way, Delta-10 THC provides an uplifting, relaxing “mental high.”

At Mr. Hemp Flower, you will always find whole-plant hemp extracts enriched in natural cannabinoids and terpenes that refresh your body and mind. When buying any hemp THC product, make sure you request a proper lab report and check brand reviews.

Continued, Is Delta-10 THC Legal in South Dakota?

South Dakota hasn’t expressly banned the manufacture and sale of hemp-derived Delta-10 THC products.

After the passage of the 2018 Agricultural Improvement Act, South Dakota updated their hemp legislation — legalizing hemp and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, with a Delta-9 THC concentration of less than 0.3 percent.

The state has specifically removed hemp from the definition of marijuana, which is considered a controlled substance in South Dakota. Therefore, if made from hemp, D-10 is not a controlled substance in the state.

South Dakota has yet to introduce legislation that would regulate hemp-derived tetrahydrocannabinols. The state is one of the latest to legalize medical marijuana. From July 1, 2021, residents with qualifying medical conditions can possess 3 ounces or less of legal cannabis.

Delta-10 THC and Federal Law

Hemp tetrahydrocannabinols like Delta-8 and Delta-10 THC are in a legal gray area federally, thanks to a loophole in the 2018 Farm Bill. The Agricultural Improvement Act of 2018 specifically excluded “hemp tetrahydrocannabinols” from the list of controlled substances on a federal level.

This leaves the status of hemp THCs which are naturally occurring in the hemp plant in trace amounts murky and complicated. Manufacturers use hemp-derived cannabidiol (CBD) and put it through chemical processes to obtain Delta-10 in larger amounts. This component is more heavily processed than Delta-8 THC, which is why it’s considered semi-synthetic.

Synthetic THCs like Spice and K2 are controlled substances created in a lab artificially. Because D-10 is made using chemical synthesis, and hence, considered semi-synthetic, it may easily fall under the group of “synthetic” tetrahydrocannabinols. Federal law does not explicitly define the term “synthetic,” which creates confusion around the legal status of this cannabinoid.

In its Interim Final Rule issued late August 2020, the Drug Enforcement Administration (DEA) stated: “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.” The hemp industry awaits the release of the Final Rule by the DEA. The Rule will either regulate or ban the manufacture, distribution, and sale of this compound.

One of the main arguments against the legality of this compound is that it’s intoxicating. According to the US Cannabis Council, the 2018 Act doesn’t legalize the production of psychoactive drugs because they’ve been derived from hemp. The hemp plant and all hemp-derived cannabinoids have been legalized because they are non-intoxicating. While this argument holds true, it’s important to notice the discrepancy between the law and the chemical nature of the cannabis plant.

Bottom line

South Dakota has yet to regulate the manufacture, distribution, and sale of hemp-derived Delta-10 THC. For now, the Mount Rushmore State hasn’t explicitly banned the compound. You can buy quality D-10 THC products online from established brands like Mr. Hemp Flower.
