Is Delta-10 THC Banned in Rhode Island? New Hemp Laws in the Ocean State

Rhode Island prohibits the sale of any product with high tetrahydrocannabinol levels that’s meant for consumption. Does that mean you are not allowed to buy Delta-10 THC products online? What about cannabidiol (CBD) products? Let’s look at the current hemp laws & regulations in the Ocean State.

Is It Legal: Rhode Island Delta-10 THC Laws

The short and simple answer is: NO! Delta-10 THC is NOT legal in Rhode Island.

What Is Delta-10 THC?

Delta-10 tetrahydrocannabinol (D-10 THC) is the newest hemp derivative on the market known for its mildly intoxicating effects resembling Cannabis sativa strains. Genuine D-10 THC extract or concentrate helps improve focus, increase energy levels, creativity, and alertness. Users describe it as something in-between Delta-9 THC and cannabinol (CBN).

The mechanisms of action of this compound in the body are unknown to the science community. It is assumed that the D-10 molecule works in the endocannabinoid system by binding to the CB1 receptors hence the intoxicating properties. Also, an animal study from the 1980s, performed by world-renewed cannabis scientist Raphael Mechoulam shows that D-10 THC does possess some psychotropic properties but it’s way milder than Delta-9 THC.

Buy Delta-10 THC in Rhode Island NOW

Because Rhode Island prohibits the sale of tetrahydrocannabinol in products meant for consumption, it’s best to avoid ordering D-10 THC online. If the law loosens up, you can always visit our top-shelf Delta-8 THC and Delta-10 THC products and order safely and discreetly.

For now, you should consider some of our hemp-derived CBD products with less than 0.3% THC. Our Full Spectrum Phytocannabinoid-Rich Hemp Oil Tincture is perfect for anyone looking for whole-plant hemp oil that’s widely known for its effectiveness.

This oil is a true PCR hemp oil because the beneficial components it contains are extracted directly from the hemp plant and combined in the oil in their original state.

Most ‘regular’ full spectrum CBD oils you see on the market are made by extracting the terpenes separately from the plant and then combining them back into the extract. This is less beneficial because it potentially disrupts the cohesiveness of the compounds in their natural state. As a result, it may prevent the extract from providing the full-blown benefits of the “entourage effect.”

Our Full Spectrum CBD Gummies are a delicious treat that brings you a strong dose of cannabidiol (CBD). It’s an understatement to say that you won’t find anything similar in the current market. These sugar-free gummies are infused with whole-plant CBD oil that contains less than 0.3% THC and is rich in terpenes like limonene, beta-myrcene, alpha-pinene, beta-pinene, and a bunch of others. Best for use before bedtime to help you feel relaxed and calm.

Continued, Is Delta-10 THC Legal in Rhode Island?

Rhode Island expressly banned the manufacture and sale of tetrahydrocannabinol and its isomers.

Rhode Island classifies all tetrahydrocannabinols (whether derived from hemp or marijuana) and its isomers as Schedule I controlled substances. The state’s “Uniform Controlled Substances Act” exempts certain forms of hemp from scheduling, but in general, prohibits the sale of any product that delivers tetrahydrocannabinol to the body.

After the 2018 Agricultural Improvement Act, Rhode Island legalized the hemp plant and cannabidiol (CBD). But, the state prohibited the manufacture and sale of any product that contains any THC amount and is intended for human or animal consumption including Delta-9 THC and isomers like Delta-8 and Delta-10 THC.

Cannabidiol (CBD) products with less than 0.3% THC made from hemp material containing less than 0.3% THC are legal in the Ocean State. You can freely buy CBD oil and other products meant for consumption if you live in Rhode Island.

Delta-10 THC and Federal Law

One of the main reasons some states in the nation decided to ban Delta-8 and Delta-10 THC is that they are intoxicating. But, what about their legal status on a federal level? Is Delta-10 THC legal under federal law? Shortly put, the situation is complicated.

Delta-10 THC occurs in the cannabis plant in very minimal concentrations even lower than Delta-8 THC. So, companies create larger quantities by using hemp-derived cannabidiol (CBD) and converting it into this substance through chemical synthesis.

This means that compared to Delta-8 THC made through regular conversion (isomerization) of one molecule into another, D-10 THC is more heavily processed. As such, it could be easily deemed a “synthetically derived tetrahydrocannabinol” by the Drug Enforcement Administration (DEA).

Namely, the DEA issued an Interim Final Rule on hemp, which confirmed the illegal status of “synthetic THC,” without providing a definition of which compounds are considered synthetic under federal law. The lack of clear provisions regarding the legality of these new hemp cannabinoids and the methods used to create them caused confusion in the industry.

As a result, the sale of D-10 THC and similar hemp THC isomers is possible because these compounds are derived from hemp. The Agricultural Improvement Act (Farm Bill) of 2018 legalized the hemp plant and all its derivatives and cannabinoids as non-intoxicating compounds.

The issue here is that hemp-THC compounds act more like marijuana than hemp. Due to that reason, the U.S. Cannabis Council stated that the Farm Bill “does not legalize the production of psychoactive drugs simply because the base material has been extracted from industrial hemp.” That said, the legality of these compounds remains unclear until the DEA’s final report provides clarification.

Bottom line

Rhode Island expressly banned the manufacture, distribution, and sale of hemp-derived Delta-10 THC. For now, this substance is NOT legal to buy in the Ocean State. If the law ever loosens up, consider Mr. Hemp Flower’s pure and potent hemp THC products.
