The Palmetto State updated its laws to distinguish hemp from marijuana. Recreational cannabis (Delta-9 THC) is a controlled substance in the state, but state law excludes “tetrahydrocannabinols in hemp or hemp products” from the marijuana definition and the controlled substances list. Delta-10 THC and Federal Law

Regarding the legality of hemp-derived THCs, the 2020 Interim Rule released late August by the Drug Enforcement Administration (DEA) stated that “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.” However, federal law doesn’t provide a definition for the term “synthetic,” which leaves things pretty unclear because it doesn’t consider every aspect of the creation of these cannabinoids.  

On the other hand, the Farm Bill of 2018 legalized all hemp-derived cannabinoids and specifically exempted “hemp tetrahydrocannabinols” from the list of controlled substances. Yet, various questions remain, including whether this substance is protected under the Act if deemed “synthetic?”  The DEA is preparing to release the Final Rule, which is expected to clarify the legality of hemp-derived THCs.
