Tennessee doesn’t explicitly prohibit the distribution and sale of D-10 THC. Because D-10 is hemp-derived, its distribution and sale likely falls under the state’s hemp regulatory framework. 

The Volunteer State updated its hemp legislation to match federal law and the 2018 Farm Bill. The state allows the manufacture, distribution, and sale of hemp and all hemp derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers if derived from hemp material containing less than 0.3% Delta-9 THC. 

The state also removed hemp from its Controlled Substances Act, which means that hemp-derived D-10 is not a prohibited substance in Tennessee. It does punish illegal possession of cannabis by a misdemeanor, which may include up to one year in jail and a fine.

As you may know, D-10 is not naturally derived, but made in a lab using unique processes and catalysts. While D-8 is created via the straightforward process of isomerization (conversion), D-10 requires special conditions to be produced. 

Chemists take hemp CBD or Delta-9 THC derived from hemp and use chemicals to effectively convert the cannabinoids into D-10 THC. This makes D-10 a more synthetic cannabinoid. There are methods to effectively isomerize this cannabinoid using food-grade procedures, but not every manufacturer possesses products made via this process. 

Because D-10 is processed more heavily with the use of catalysts, chances are higher for it to be considered “synthetic” by the Drug Enforcement Administration (DEA). Technically, this hemp derivative exists in a gray area because it’s isomerized using hemp-derived cannabinoids. 

But, that’s no guarantee for its legal status. In its 2020 Interim Final Rule, the DEA stated that all synthetically derived tetrahydrocannabinols are illegal. The levels of Delta-9 THC contained in a product infused with “synthetic” compounds doesn’t matter because they are deemed illegal nonetheless. In addition, the report stated that the 2018 Farm Bill did not impact the legal status of synthetically derived tetrahydrocannabinols. 

For now, the sale and distribution of Delta-10 THC products is not explicitly banned under any law. Is this compound fully synthetic? No, it’s not because synthetic tetrahydrocannabinols exhibit intense, life-threatening effects none of which has been shown by D-10 THC. But, it’s also not a natural cannabinoid. So, it exists somewhere in the grayest area of the hemp laws.
