Hemp and hemp-derived cannabinoids, including cannabidiol, shall be considered an agricultural commodity and not a controlled substance.” 
Every individual that wants to plant, grow, harvest, possess, process, distribute, buy, or sell industrial hemp for commercial purposes in New Jersey needs to apply for a license to the Secretary of Agriculture.

New Jersey is one of the first three states to win federal approval of its hemp plan.
In December 2019, the United States Department of Agriculture approved Jersey’s hemp regulations — giving the state the green light to allow commercial hemp cultivation in 2020.
The Garden State doesn’t explicitly allow or prohibit the sale and possession of smokable hemp flower, so we can assume that smokable hemp products (as per the state’s definition of hemp and hemp products for human consumption) remain legal in the state.

The new bill establishes a program that allows for cultivation, handling, processing, transport, and the sale of hemp. The law also repeals the state’s pilot program with a permanent program — The Hemp Farming Act — that will prepare the ground for the promising hemp market.
The Act defines “hemp product” as:
“A finished product with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent that is derived from or made by processing a hemp plant or plant part and prepared in a form available for commercial sale. The term includes cosmetics, personal care products, food intended for human or animal consumption, cloth, cordage, fiber, fuel, paint, paper, particleboard, plastics, and any product containing one or more hemp-derived cannabinoids such as cannabidiol. Hemp products shall not be considered controlled substances.” 
New Jersey Hemp Farming Act states that it is legal to possess hemp products. But it is unlawful for someone that is not a licensed hemp producer to cultivate, handle or process living plant material, leaf material, or floral material from hemp.
