Is delta-8 THC legal?
Delta-8 THC is legal depending on where you are. At the federal level in the US, delta-8 THC is not defined as a controlled substance. Similar to CBD, delta-8 was placed into a legal loophole by the 2018 Farm Bill that made the compound legal as long as it contained less than 0.3% delta-9 THC by dry weight volume. While delta-8 is tolerated by the federal government, the Federal Analog Act prohibits analogs of any controlled substance, such as THC. However, this act has yet to be enforced.
