In alignment with the 2018 Farm Bill, smokable hemp flower is legal in Pennsylvania, and industrial hemp has been identified as Cannabis sativa L. and any other part of the plant, growing or otherwise, with a delta-9 THC content of less than 0.3% on a dry-weight basis.

As for the sale of hemp flower, there are no explicit bans, and as a result, it’s legal to sell.

In order to grow industrial hemp, farmers must be licensed by the Pennsylvania Dept. of Agriculture. Licenses cost $600 per year for up to 5 locations, and they will not be granted to anyone convicted of a drug felony 10 years prior to application.

Inspectors are permitted to visit farms and choose any plants to test. Plants with a content of more than 0.3% THC may be destroyed.

Processors, meanwhile, are required to have a license, unless they’re processing hemp-derived CBD into food products. In which case, processors will need to register with the state’s Bureau of Food Safety. These processors will also need to be licensed as a food establishment.

There is no possession limit for smokable hemp flower.
