After the 2018 Farm Bill, Oklahoma updated its hemp laws to legalize hemp and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a THC concentration of less than 0.3% on a dry weight basis. 

The Sooner State laws exempt hemp-derived products from the definition of marijuana. The Oklahoma Public Health Code specifies that tetrahydrocannabinols from hemp are not to be classified the same way as tetrahydrocannabinols derived from marijuana which are listed as controlled substances. 

The state hasn’t explicitly banned the sale and possession of hemp-derived D-8 THC. This means that when it comes from the hemp plant, D-8 is legal in Oklahoma. 

State hemp law doesn’t place any age restrictions on hemp-derived products because they are non-intoxicating. But, many retailers don’t sell D-8 products to consumers younger than 21. 

Delta-8 THC and Federal Law 

The legal status of Delta-8 THC on a federal level is complicated. 

The delayed response by the federal government prompted states to regulate D-8 independently. Florida serves as an excellent example of a friendly state that adopted D-8 products under its hemp regulations. States like Kentucky and California, on the other hand, banned the sale and use of products containing this hemp derivative. 

Most experts agree that under the 2018 Farm Bill, naturally-extracted, hemp-derived Delta-8 THC is a legal cannabinoid. 

But, because this compound is found in the hemp plant in tiny amounts, natural extraction is not an option from a financial perspective. So, instead of extracting it in its organic state, manufacturers use isomerization to convert hemp-derived cannabidiol (CBD) into D-8. 

From a legal perspective, D-8 made from hemp-derived CBD is in a grey area. Why? Some experts suggest that because it’s converted from CBD, the feds might consider it “synthetically derived.” Federal law bans any type of “synthetically derived tetrahydrocannabinols” because they are made from non-organic compounds and cause potentially lethal effects. 

The question here is whether D-8 made from CBD falls under this category. And that’s a difficult one because federal law doesn’t explicitly define the term “synthetically derived tetrahydrocannabinols.” 

This issue alone leaves space for the feds to label D-8 as “synthetic” when she’s NOT. If we were to disregard the conversion process D-8 goes through, this cannabinoid is still made from naturally extracted hemp cannabinoids. The same cannot be said for “synthetic THCs.”
