Is Delta 8 THC Legal in Ohio?

Yes, hemp-derived delta 8 THC is legal to sell and possess in Ohio.

You can buy delta 8 products legally in Ohio without a prescription or medical marijuana patient card. In July 2019, Ohio updated its legislation to legalize hemp and all cannabinoids (Senate Bill 57), derivatives, and extracts with less than 0.3% THC.

The state updated its Controlled Substances Act to exclude “tetrahydrocannabinols found in hemp and hemp products” from the list of controlled substances. When derived from legal hemp material, delta 8 is a legal substance in Ohio.

For now, the state is not making efforts to ban or restrict the sale and possession of delta 8 THC.

Hemp-derived products are considered an “agricultural commodity” in the state and have no possession limits. But, most retailers have created their own restrictions and avoid selling it to adults below 21 years of age.

Where to Buy Delta 8 THC in Ohio?

Walking down the streets of Ohio, you might have noticed a variety of shops that sell products with this rare cannabinoid. But, which supplier can you trust? Should you buy your D8 from these shops or order online?

Before buying your D8, you should know that the market is largely unregulated, and many companies sell cheap low-quality products. Typical outlets are gas stations and convenience stores, so try to avoid them because they offer products that haven’t necessarily been screened for quality.

Other retailers like CBD shops and dispensaries do offer quality products. In fact, you might find some of Mr. Hemp Flower’s in there. But, considering the costs of keeping a brick-and-mortar store, the products might be pricier than those offered online.

So, the best alternative is to shop for D-8 online from licensed shops that offer tested products. At Mr. Hemp Flower, we use USA-grown hemp for extraction of cannabidiol (CBD).

A third-party lab tests all our products, and each comes with a detailed Certificate of Analysis and terpene report. We go above and beyond to ensure you’re getting natural, top-shelf items made with healthy ingredients.

Why Mr. Hemp Flower?

If you, like us, believe in the power of the hemp plant as a whole, you’ll love our products. We focus on full spectrum cannabinoid formulas and strive to optimize their quality because whole-plant extracts offer an unmatched experience.

Delta 8 is legal in Ohio, so you can order online any product from Mr. Hemp Flower and have it delivered straight to your door. If you’re a seasoned user and love to dab, we have the best delta 8 THC gummies and pre-rolls, an absolute must-try.

What is Delta 8 THC?

It’s a minor hemp cannabinoid present in the plant in minuscule amounts (less than 0.1%). Natural extraction of D-8 is not financially viable due to its concentration in the plant. So, chemists convert hemp-derived cannabidiol (CBD) into D-8 via isomerization.

As a “twin”molecule to classic THC or delta 9, this compound will still get you intoxicated or “high,” but to a lesser extent. According to research, D-8 is around half the potency of D-9 if consumed at the same dose. But unlike D-9, it produces “mild” intoxication without the typical feeling of intense anxiety and paranoia.

Delta 8 THC and Federal Law

The legality of delta 8 on a federal level is confusing.

The US federal government delayed its response to regulating the hemp industry. As the market’s development progressed, businesses started exploring new and exciting hemp cannabinoid products, which led to the appearance of D-8 THC.

But unlike other hemp cannabinoids that are directly extracted from the hemp plant, D8 THC is made by converting hemp-derived cannabidiol (CBD). This process of chemically converting one compound into another is called isomerization and may put D-8 in the category of “synthetically derived tetrahydrocannabinols.”

Federal law bans synthetic THC, and for a good reason: they are dangerous, lab-made chemicals that have nothing in common with the cannabis plant. Synthetic THC like Spice and K2, mimic the effects of real delta 9 THC, but exhibit more intense, unpredictable, and, in some cases, life-threatening effects.

But, because the law doesn’t explicitly define “synthetically derived tetrahydrocannabinols,” there’s a possibility that D-8 made from CBD can be considered one.

Most experts agree that D8 THC is not a naturally extracted hemp cannabinoid, but it’s also far from being a synthetic one. The difference between D-8 derived from CBD and “synthetic THC” is in that the latter ones are created in a lab from non-organic sources.

According to a document by the National Institute on Drug Abuse, “synthetic cannabinoids refer to a growing number of man-made mind-altering chemicals that are either sprayed on dried, shredded plant material and can be smoked (herbal incense) or sold as liquids to be vaporized and inhaled in e-cigarettes and other devices (liquid incense).”

This definition does not encompass or describe delta 8 converted from hemp CBD. Because the 2018 Farm Bill legalized hemp and all its derivatives, delta 8 THC is currently in a legal grey area.
