Yes, hemp-derived Delta-8 THC is legal in Maine. 

Maine updated its legislation after the passage of the 2018 Farm Bill to accommodate hemp and hemp-derived products. The state legalized hemp and all derivatives, extracts, and cannabinoids when extracted from hemp material that contains less than 0.3% THC. 

In the definition of hemp, the Pine Tree State includes hemp-derived “topical or ingestible consumer products, including food, food additives and food products derived from hemp,” if in their final form they contain legal levels of THC. 

Maine hasn’t explicitly banned the use and possession of hemp-derived Delta-8. 

The state also excluded hemp from the definition of marijuana and the list of controlled substances. The Pine Tree State doesn’t define possession limits on hemp-derived products, so presumably, you can buy as much D8 as you need. But, most retailers have placed age restrictions on D8 and sell products only to people who are 21 years of age or older. 

Delta-8 THC and Federal Law 

Delta-8 and federal law have a bit of a bumpy relationship. 

Everyone agrees that naturally occurring Delta-8 THC in the hemp plant is legal under federal law. 

The problem with its legality arises when D8 is not extracted in its organic state from the hemp plant but is converted from hemp-derived cannabidiol (CBD). The conversion of one hemp cannabinoid into another may label D8 that’s currently sold on the market, a “synthetically derived” tetrahydrocannabinol. 

Under federal law, the manufacturing and sale of “synthetically derived” tetrahydrocannabinols like Spice and K2 is prohibited. In 2020, the Drug Enforcement Administration (DEA) issued a report that was aimed at the current spread of “CBD converted Delta-8” and reaffirmed that “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.”

This report further complicated things instead of clarifying them because it doesn’t clearly define the term “synthetically derived THC.” While D8 is not a “natural” THC, the question is: Can it be considered a “synthetic” one considering the fact that “synthetic THC” is made in a lab without the involvement of any cannabis plant material? 

We can only hope that this cannabinoid will be legalized and regulated properly by federal law.
