Louisiana updated its legislation after the passage of the 2018 Farm Bill. In 2019, Governor Bel Edwards signed HB 491 into law, authorizing the sale of hemp-derived products with less than 0.3% THC. 

The Pelican State removed hemp from its Controlled Substances Act and legalized all its extracts, derivatives, cannabinoids, isomers, acids, and salts as long as they’re produced from hemp material within the legal levels of THC. 

The state also excluded tetrahydrocannabinols in hemp from the controlled substances list. Marijuana-derived THCs and their synthetic equivalents and derivatives are illegal in the Pelican State. 

Louisiana doesn’t define possession limits or put an age restriction on hemp CBD products. But, because delta 8 is an intoxicating cannabinoid, most companies sell their products to adults of at least 21 years of age or older.

What is Delta 8 THC? 

Also known as “weed lite,” delta 8 is a sister molecule to the primary intoxicating hemp cannabinoid delta 9 THC (or THC). 

Despite having an almost identical chemical structure, the difference between D8 and D9 is in the location of their double bond. Researchers contribute the potential intoxicating effects of THCs to their double bond. The D8 isomer has its double bond at the 8th carbon atom, while D9 at the 9th. 

But, this seemingly small difference contributes to D8’s mildly intoxicating effects. Studies show that this compound is 50 to 70 percent less intoxicating than Delta-9. Delta 8 THC and Federal Law

This process of conversion is the main “culprit” of the sticky legality surrounding this compound. 

The reason for that is because when made from hemp CBD, D8 could be considered “synthetically derived.” Federal law prohibits all synthetically derived tetrahydrocannabinols, as clarified by the 2020 Drug Enforcement Administration (DEA) report

The report doesn’t define the term “synthetically derived,” which creates further confusion. Why? Because synthetically derived tetrahydrocannabinols like Spice and K2 are made in a lab without using any cannabis plant material. 

D8 is a real tetrahydrocannabinol and, in this case, made with the use of hemp-derived cannabidiol (CBD). It’s clear that while D8 derived from CBD is not “natural,” it’s also not “synthetic,” and as such, requires separate regulation.
