Is Delta 8 THC Legal in Louisiana?
Yes, hemp-derived delta 8 THC is legal in Louisiana.
Despite the attempts, the state hasn’t explicitly banned the use and possession of hemp-derived delta 8 THC.
The only exceptions are smokable hemp products meant for inhalation. Products like pre-rolls, cigarettes, and vapes are banned in Louisiana under HB 843, enacted in 2020.
Louisiana updated its legislation after the passage of the 2018 Farm Bill. In 2019, Governor Bel Edwards signed HB 491 into law, authorizing the sale of hemp-derived products with less than 0.3% THC.
The Pelican State removed hemp from its Controlled Substances Act and legalized all its extracts, derivatives, cannabinoids, isomers, acids, and salts as long as they’re produced from hemp material within the legal levels of THC.
The state also excluded tetrahydrocannabinols in hemp from the controlled substances list. Marijuana-derived THCs and their synthetic equivalents and derivatives are illegal in the Pelican State.
Louisiana doesn’t define possession limits or put an age restriction on hemp CBD products. But, because delta 8 is an intoxicating cannabinoid, most companies sell their products to adults of at least 21 years of age or older.
Where to Buy Delta 8 THC in Louisiana?
That’s an easy one: online hemp retailers sell the very best delta 8 THC products. The industry is unfortunately largely unregulated, so buying from a trusted company is key. Mr. Hemp Flower makes your health and safety a priority by offering carefully screened D8 products.
Our collection of delta 8 is tested by a third-party lab, and so are all of our products.
Delta 8 is legal in Louisiana, so you can freely order a wide range of products online. We offer top-shelf gummies, pre-rolls, soft gel capsules, concentrates, and vape cartridges. We ship fast, and in discreet packaging, so you’ll receive your D8 faster than a hot knife through butter.
Why is choosing a reliable delta 8 company so important?
As a user, you have the right to know what’s in the products you’re buying. Just because D8 is unregulated, that’s not an excuse for companies and retailers to sell untested products. We recommend avoiding unlicensed outlets like convenience stores and gas stations that simply don’t care about quality screening.
Also, the legality of a hemp-derived product depends on the levels of THC it contains. At Mr. Hemp Flower, we manufacture our own products that are compliant with the 2018 Farm Bill and contain less than 0.3% THC.
We offer a Certificate of Analysis with each product and are extremely transparent about the ingredients. Oh, did we mention the raving reviews our D8 gets from customers? Don’t miss out!
What is Delta 8 THC?
Also known as “weed lite,” delta 8 is a sister molecule to the primary intoxicating hemp cannabinoid — delta 9 THC (or THC).
Despite having an almost identical chemical structure, the difference between D8 and D9 is in the location of their double bond. Researchers contribute the potential intoxicating effects of THCs to their double bond. The D8 isomer has its double bond at the 8th carbon atom, while D9 at the 9th.
But, this seemingly small difference contributes to D8’s mildly intoxicating effects. Studies show that this compound is 50 to 70 percent less intoxicating than Delta-9. Users attribute D8 a mild, clear-headed high that keeps them productive and doesn’t make them paranoid or anxious the way THC does.
Delta 8 THC and Federal Law
D8’s legality on a federal level is confusing, to say the least. Under the 2018 Farm Bill, naturally derived delta 8 THC from hemp is 100% legal in the United States.
So, if extracted in its organic state, hemp-derived D8 is legal on a federal level. But, D8 is found in small concentrations in many hemp strains. So, to produce it in larger quantities and make it financially viable, manufacturers convert (chemically alter) hemp-derived cannabidiol (CBD) into delta 8. This process of conversion is the main “culprit” of the sticky legality surrounding this compound.
The reason for that is because when made from hemp CBD, D8 could be considered “synthetically derived.” Federal law prohibits all synthetically derived tetrahydrocannabinols, as clarified by the 2020 Drug Enforcement Administration (DEA) report.
The report doesn’t define the term “synthetically derived,” which creates further confusion. Why? Because synthetically derived tetrahydrocannabinols like Spice and K2 are made in a lab without using any cannabis plant material.
D8 is a real tetrahydrocannabinol and, in this case, made with the use of hemp-derived cannabidiol (CBD). It’s clear that while D8 derived from CBD is not “natural,” it’s also not “synthetic,” and as such, requires separate regulation.
