State regulators, researchers, and chemists indicate willingness to regulate these products for sale in licensed cannabis dispensaries. In April, Washington’s Liquor and Cannabis Board (LCB) issued a policy statement that the conversion of hemp cannabinoids into ANY other cannabinoid is illegal under state’s cannabis regulations.
They later clarified that the statement was “advisory only.” The notice was an interpretation of the law regarding hemp tetrahydrocannabinols and the legal cannabis market. The main premise of the suggested ban is that the state only allows the sale of marijuana derived tetrahydrocannabinols as part of their legal cannabis system.
While the heated debate continues and the LCB is drafting a formal rule, Delta-10 THC derived from hemp remains legal in Washington.
After the passage of the 2018 Farm Bill, the Evergreen State updated its hemp legislation to match federal law. The state specifically excludes the hemp plant from its controlled substances list. Until further notice, Delta-10 THC derived from hemp is not an illegal substance in this state.

The legal status of Delta-10 THC on a federal level is murky and complicated.

The legal complexity of D-10 THC comes from the way it’s produced. This derivative is made from hemp cannabinoids like cannabidiol (CBD) in addition to other catalysts. Its production is not a straightforward process like it is with Delta-8 THC, but requires knowledge and special conditions.
Because this compound doesn’t exactly exist in the cannabis plant on its own — and it’s more heavily processed than its “sister” cannabinoid Delta-8 THC — it could more easily fall under the status of a “synthetically derived tetrahydrocannabinol.”
The only thing that classifies it within the legal gray matter is that it comes from hemp-derived compounds and falls under the protection of the 2018 Farm Bill. Yet, what makes its legal status questionable is the Interim Rule issued by the Drug Enforcement Administration (DEA) in August 2020.
In the report, the DEA clarified that “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.” The report did not further define the term “synthetic,” which is the root of confusion as D-10 doesn’t quite fit the classic type of “synthetic tetrahydrocannabinols,” like Spice and K2. True “synthetic” THCs are life-threatening substances that could trigger dangerous and intense side effects.
