Virginia hasn’t expressly banned the production, distribution, and sale of hemp-derived Delta-10 THC products. To align state with federal law, Virginia passed Senate Bill 247 and legalized hemp and any derivative, extract, cannabinoid, isomers, acid, salt or salt of an isomer with a Delta-9 THC concentration of less than 0.3 percent.  

The state also updated its Controlled Substances Act and removed hemp and hemp-derived THCs from the list of illegal substances. 

Like neighbors Tennessee and North Carolina, The Old Dominion has yet to introduce legislation regarding hemp tetrahydrocannabinols like Delta-10. They’ve made progress in the field of cannabis by legalizing recreational marijuana. 

Adult-use cannabis has been legal in Virginia starting July 1, 2021, as the Old Dominion became the first Southern state to legalize weed. That said, it won’t be a surprise if the state follows Colorado’s or Oregon’s footsteps and legalizes D-8 and D-10 as part of their legal cannabis system. 

Delta-10 THC and Federal Law 

Is Delta-10 THC legal under federal law? The legality of this compound is complicated because of the multifaceted relationship between cannabis and the law. 

As of this writing, the legal status of D-10 THC remains in a gray area. To get over the uncertainty, some states have decided to ban or restrict products derived from hemp that contain hemp tetrahydrocannabinols like D-8 and D-10 THC. 

Other states, like Virginia, have yet to pass laws that regulate this cannabinoid. Federally, the 2018 Agricultural Improvement Act (Farm Bill) explicitly carved out “tetrahydrocannabinols in hemp” from the list of controlled substances. So, the view of the legality of these compounds comes from this “loophole” created by the Act. 

However, compounds like D-10 THC exist in the hemp plant in trace amounts and cannot be extracted or infused into products in larger quantities. Therefore, labs convert hemp-derived cannabidiol (CBD) into D-10 using various processes and chemicals. Because this compound is more heavily processed, it borders more on the synthetic side rather than the natural. 

And the one thing that the Act didn’t impact was the control status of “synthetically derived tetrahydrocannabinols.” Meaning, Delta-10 THC, which is semi-synthetic, may fall under this category and remain an illegal substance federally. The same is confirmed in the 2020 Interim Final Rule by the DEA, only without a clear definition of the term “synthetically derived tetrahydrocannabinol.”

The main thing that makes D-10 a potentially synthetic THC is the way it’s manufactured via chemical synthesis. Compared to truly lab-created synthetic THC molecules like Spice and K2, this compound exists naturally in the hemp plant and is made from hemp-derived CBD. The debate regarding the legality of these compounds is ongoing as the industry awaits the release of the Final Rule by the DEA.
