Is Delta-10 THC a Controlled Substance in Kansas? Hemp Laws & Regulations

Delta 10 Kansas

Delta-10 THC is a form of THC with energizing, uplifting effects derived from hemp cannabidiol (CBD). If you’ve heard about this substance and want to try it, you’re probably wondering if it’s legal to buy in Kansas. Let’s look at the hemp laws and regulations in the Sunflower State & where to buy legal products containing this cannabinoid.

Is It Legal: Kansas Delta-10 THC Laws

The short and simple answer is

Delta-10 THC is LEGAL in Kansas.

What Is Delta-10 THC?

Delta-10 tetrahydrocannabinol (D-10 THC) is the latest isomer of Delta-9 THC to hit the market. This substance is new, so we know little about its effects. No formal clinical studies are exploring D-10 THC, so we’re left with anecdotal reports from people who’ve tried it (including our team).

So far, we know that this compound comes close to Delta-8 THC in terms of potency and D-8 THC is roughly half as potent as D-9 THC. Based on anecdotal reports, this compound is more stimulating and better than D-9 THC for promoting creativity, flow states, and focus. All in all, Delta-10 THC has fewer side effects than D-9, which is a feature likely to make it a staple in the hemp industry over the next few years.

Buy Delta-10 THC in Kansas NOW

Kansas doesn’t restrict the sale of hemp-derived Delta-10 THC products for now. So, you can probably find a bunch of products sold at local CBD shops and non-cannabinoid stores. Does that mean you should go out and buy them? Well, purchasing D-10 THC is a bit more challenging than other cannabinoids.

Because this cannabinoid is new to the market, not every vendor offers a properly developed, safe formula. Most vendors have good intentions, but they simply don’t produce high-quality formulas. That’s why it’s important to check where you’re getting your products from.

The best option, for now, is to order Delta-10 THC online directly from the maker’s website.

Mr. Hemp Flower offers a high-quality D-10 THC formula that’s genuine and safe. We manufacture our own goods and work with third-party labs that test all our products. Continued, Is Delta-10 THC Legal in Kansas?

Kansas hasn’t explicitly banned the distribution and sale of hemp-derived Delta-10 THC.

Some states have laws that prevent access to Delta-8 and Delta-10 THC, but Kansas is not one of them.

After the 2018 Farm Bill, the Sunflower State updated its laws to legalize hemp and hemp products with a Delta-9 THC concentration of 0.3 percent or less. Therefore, under Kansas law, all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers with less than 0.3% THC are legal in the state.

The state also amended its Controlled Substances Act to remove “tetrahydrocannabinols obtained from hemp” from the definition of marijuana. Recreational cannabis is fully illegal in the Sunflower State and possession of even small amounts is considered a misdemeanor crime.

Kansas has outlawed synthetic cannabinoids as of March 2010, becoming the first state to introduce such legislation. Because of this ban, this state is highly probable to pass legislation banning hemp tetrahydrocannabinols like Delta-8 and Delta-10 THC.

Delta-10 THC and Federal Law

The 2018 Farm Bill legalized all naturally derived hemp cannabinoids — except for Delta-9 THC. Cannabinoids like cannabidiol (CBD), cannabigerol (CBG), and cannabinol (CBN) can be lawfully extracted directly from the plant, in their organic state.

As you know, that’s not the case with hemp-derived Delta-8 and Delta-10 THC, because they are found in minuscule concentrations. Therefore, chemists use hemp-derived cannabidiol (CBD) and convert it into D-10 THC, with the help of catalysts.

And so, the legal complexities of Delta-10 THC come from the way this compound is manufactured. Technically, D-10 THC comes from hemp-CBD, which makes it legal under the 2018 Farm Bill. But because it’s heavily processed, it’s also semi-synthetic, and as such, may easily fall under the list of controlled substances.

In August 2020, during the Delta-8 THC boom, the U.S. Drug Enforcement Administration (“DEA”) released its Interim Rule on hemp, which stated that “all synthetically derived tetrahydrocannabinols” are illegal under federal law. But, the rule left many questions unanswered, which are likely to be clarified in the release of the Final Rule.

The Final Rule, on which the DEA is still working, will contain answers regarding the legal status of Delta-10 THC. For now, this cannabinoid exists in a gray legal area.

Bottom line

Kansas doesn’t explicitly prohibit the distribution and sale of hemp-derived Delta-8 and Delta-10 THC. As of this writing, this substance is legal to buy in the Sunflower State. Kansas outlawed synthetically derived cannabinoids, but it also removed hemp tetrahydrocannabinols from the list of controlled substances.
