As you probably know, the legality of reselling hemp depends on state and federal laws. As of this writing, federal hemp regulations are in a state of flux. On a state level, each state can regulate cultivation, production, and marketing of hemp, in accordance with current laws and regulations.
Federal laws on reselling hemp flower
After President Trump signed the 2018 Farm Bill, hemp became a legal crop in the United States. The hemp plant is no longer classified as a controlled substance, and states can pass laws on its cultivation, production, distribution, and sale. The United States Department of Agriculture (USDA) has regulatory oversight over hemp. To regulate the crop, the USDA released an Interim Rule, which, among other things, provides regulations on hemp testing and disposal on a state level. The Interim Rule is not final yet, but became effective immediately upon publication.
The Interim Rule sets requirements for testing of Total THC content, or the sum of delta-9 THC and the potential conversion of delta-9 THCA, on a dry weight basis. That said, hemp that tests over 0.3% THC is considered “hot” and must be disposed of.
Because the hemp industry is still developing — and until better hemp varieties are planted — the USDA decided to consider the Interim Rule a draft, which delays the Total THC testing requirements until October 31, 2021 (or until the release of the final rule). Some states have already included the Total THC testing in their pilot programs, and Arkansas is one of them. Under the state Industrial Hemp Program, delta-9 THC is recognized as being THC + 0.877*THCA .
State laws on reselling hemp flower
Arkansas will continue to operate under its pilot program for the 2020 growing season. The state’s hemp program was created in 2017 under the 2014 Farm Bill. The state Plant Board overlooks the hemp research program that requires a licence to cultivate and process raw hemp and industrial hemp products. In 2019, Arkansas removed hemp CBD that contains 0.3% THC, or less, on a dry weight basis, and that’s not an approved FDA drug from its list of controlled substances.
Arkansas has a friendly attitude towards hemp CBD products and allows retailers to sell hemp CBD without a license. The state doesn’t prohibit the sale of hemp smokable products, but Arkansas farmers are allowed to sell their hemp flower only to licensed processors, not to consumers directly. Furthermore, licensed processors must turn the flower into a CBD product and then offer it for sale. As a result, many retailers obtain hemp smokable products from other U.S. states. Arkansas allows the sale of “publicly marketable products,” only if:
- The product does not include any living plants, viable seeds, leaf materials, floral materials, or decarboxylated delta-9-THC content above 0.3 percent;
- The product does include, without limitation, the following products: bare stalks, bast fiber, hurd extracts, nonviable roots, nonviable seeds, seed oil, and plant extracts (excluding products containing decarboxylated delta-9-THC content above 0.3 percent).
- The product is CBD that was derived from industrial hemp, as defined in the regulation; or
- The product is CBD that is approved as a prescription medication by the United States Food and Drug Administration .
