In March 2020, the state enacted House Bill 1008 to legalize the growth, production, and transportation of hemp in the state. The bill legalized hemp-derived products with less than 0.3% delta 9 THC (without mentioning anything about CBD). 

Section 21 of the new bill prohibits the sale and use of industrial hemp for smoking or inhaling. This rules out all CBD flower and vape products, including HHC flower. Violating the smokable hemp ban is a Class I misdemeanor. 

However, HHC that doesn’t come in the form of a vape or smokable product is perfectly legal in South Dakota. 

And, it’ll likely stay that way. South Dakota lawmakers recently proposed a new measure of regulation (House Bill 1292) that, if enacted, would limit the sale of delta 8, HHC, and THC-O products to those 21 and older. It’s great to see more and more states looking to regulate instead of banning these products.
