What Does the Future Hold for HHC Flower in Kentucky?

HHC Flower in Kentucky

Kentucky’s current laws are not paying homage to the state’s hemp history. In the 19th and 20th centuries, Kentucky was the greatest hemp producer in the US with the first crop raised in 1775.

Today, the state is facing potential restrictions of hemp flower and intoxicating hemp-derived cannabinoids like HHC. Can you buy HHC-coated hemp flower in the Bluegrass State? Let’s take a look.

Is HHC Flower Legal in Kentucky?

HHC flower is legal in Kentucky.

But that might change soon.

The state is in the process of voting on an emergency bill that would ban HHC (among other forms of intoxicating hemp cannabinoids) and smokable hemp products like hemp cigarettes, cigars, and hemp flower.

For now, the state has issued a temporary injunction, which keeps hemp-derived intoxicating cannabinoids like delta 8 and HHC legal (after being deemed illegal by the Kentucky Department of Agriculture). The department sent licensed holders a letter in April 2021 stating that distributing delta 8 is prohibited and could get them expelled from the Hemp Licensing Program.

The injunction stated that delta 8 hadn’t been explicitly banned or restricted by the legislation, so until formal rulemaking occurs, it’s legal in Kentucky.

As a result, a state Senate committee has started the process of regulating intoxicating products derived from hemp, particularly delta 8. The Kentucky Senate advanced a bill that, if adopted, would ban hemp compounds that can get users high.

What is HHC Flower?

It’s CBD flower coated with high concentrations of liquid hexahydrocannabinol (HHC).

This cannabinoid is found in hemp in tiny amounts and — like delta 10 and delta 8 — possesses intoxicating properties. HHC is the most shelf-stable form of THC, immune to heat and UV radiation, and manufactured using hemp-derived materials.

In terms of effects, this cannabinoid produces mild feelings of euphoria and is more relaxing than stimulating, which makes it more similar to delta 8 than delta 9.
