The department sent licensed holders a letter in April 2021 stating that distributing delta 8 is prohibited and could get them expelled from the Hemp Licensing Program. 

The injunction stated that delta 8 hadn’t been explicitly banned or restricted by the legislation, so until formal rulemaking occurs, it’s legal in Kentucky. 

As a result, a state Senate committee has started the process of regulating intoxicating products derived from hemp, particularly delta 8. The Kentucky Senate advanced a bill that, if adopted, would ban hemp compounds that can get users high.
