Is Hemp Flower Legal in the District of Columbia?
Hemp and hemp-derived products are not regulated in the District of Columbia.
This means that hemp is legal on a federal level, but there are no laws to regulate the processing, sale, and possession of hemp in Washington, D.C.
The 2018 Farm Bill removed hemp from the definition of marijuana under the Controlled Substance Act, so hemp is no longer a Schedule I controlled substance.
Under federal law, the term ‘hemp’ means:
“The plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis .”
While the District doesn’t really have the space needed to cultivate hemp for commercial purposes, establishing regulations for commercial use of hemp may come after the implementation of a marijuana sales program.
Under Initiative 71, marijuana use is legal in the capital. Individuals 21 and older can legally possess, use, purchase, or transport up to two ounces of marijuana within the District of Columbia.
They can also grow up to three mature and three immature marijuana plants in their homes as well as transfer up to one ounce of weed to another individual. But, as we mentioned, the commercial sale of marijuana is prohibited.
