Hemp flower is legal in Utah, but only licensed individuals can possess and market it. The state passed a bill that amended provisions related to industrial hemp. Governor Herbert signed the bill into law in March 2019.
Under the law, “industrial hemp” means any part of a cannabis plant, whether growing or not, with a concentration of less than 0.3% tetrahydrocannabinol by dry weight. 
Licensed individuals can cultivate, handle, process, or market floral materials derived from industrial hemp.
The sale of industrial hemp products (and CBD products) is legal in Utah if registered with the Department of Agriculture and Food. 
Are hemp smokables legal in Utah?
The law doesn’t explicitly state the legality of hemp smokables, but according to the Utah Department of Agriculture and Food, most common non-approved medical dosage forms are: 
- Smokeable flower
- Rolled joints
- Non-cubed Gummies
- CBD water
- Food additives
This means that the hemp smokable can’t be registered with the Department. For a hemp product to be legally sold in Utah, it must be registered and properly labeled.

Is CBD Oil Legal in Utah?
Hemp-derived CBD oil with less than 0.3% THC is legal to possess and use in Utah. Individuals interested in cultivating, processing, or selling hemp extracts containing less than .3% THC in Utah must be licensed by the Utah Department of Agriculture and Food. 
Furthermore, individuals interested in selling CBD oil must register their CBD products with the Department of Agriculture and Food. The product registered with the Department has to meet all testing, labeling, and other requirements.
Utah law makes a distinction between “industrial hemp product” and “cannabinoid product.”
Industrial hemp product means a product derived from, or made by, processing industrial hemp plants or industrial hemp parts.
The law doesn’t state which products are considered hemp products, but we can assume it includes both non-consumable and consumable hemp products. “Cannabinoid products” is a category that falls under “hemp products.”
Cannabinoid product means a chemical compound extracted from a hemp product that:
- is processed into a medicinal dosage form; and
- contains less than 0.3% tetrahydrocannabinol by dry weight.
Furthermore, the law explains the meaning of “medicinal dosage,” and lists:
a concentrated oil
a sublingual preparation
a topical preparation
a transdermal preparation
a gelatinous cube, gelatinous rectangular cuboid, or lozenge in a cube or rectangular cuboid shape; or
other preparations that the Department approves.
On the other hand, industrial hemp products such as CBD water, non-cubed gummies, candy, and other food products are not allowed in Utah.
