  • All non-seed parts and varieties of the Cannabis sativa L. plant, growing or not, that contain an average delta-9tetrahydrocannabinol (THC) concentration that does not exceed three-tenths of one percent (0.3%) on a dry weight basis or the maximum concentration allowed under federal law, whichever is greater. 
  • Any Cannabis sativa L. seed that is part of a growing crop, retained by a grower for future planting, or used for processing into or use as agricultural hemp seed.
  • “Industrial hemp” includes industrial hemp commodities and products and topical or ingestible animal and consumer products derived from industrial hemp with a delta-9 tetrahydrocannabinol concentration of not more than three-tenths of one percent (0.3%) on a dry weight basis.

The Department of Agriculture is working to put out applications for Producer Registration and Agricultural Propagule and Seed Permit this fall for the 2020 growing season. [4]

  • The Producer Registration authorizes a person who is a Missouri resident, or an entity that is domiciled in this state, to cultivate industrial hemp.
  • The Agricultural Hemp Propagule and Seed Permit authorize a permit holder to sell, distribute, or offer for sale any viable agricultural hemp propagule or agricultural hemp seed to registered producers or other permit holders. 

Is CBD Legal in Missouri?

Hemp-derived CBD is legal in all 50 states. The Missouri law doesn’t specifically state the legality of CBD for commercial use, so the general use of the compound remains in the gray area.  

In 2014, then Gov. Nixon signed into law the Missouri Medical Marijuana Bill, which legalized the use of CBD oil for patients with intractable epilepsy. The bill requires neurologists to determine whether the epilepsy of a patient doesn’t respond to at least three treatment options for the patient to become eligible for Hemp Extract Card. [5]

Eligible patients can obtain hemp extract that contains at least 5% CBD and no more than 0.3% THC. In Missouri, two non-profits can grow and sell cannabis for oil for eligible patients. 

Medical Marijuana is Legal in Missouri

Missouri became the 32nd state to legalize medical cannabis in 2018. The state allows qualified patients to grow up to six plants and purchase at least 4 ounces of cannabis per month. Physicians can recommend cannabis for any chronic, debilitating, or terminal medical condition.
