Thanks to the Farm Bill of 2018, this plant was legalized federally. As a result, THC that naturally occurs in the plant (hemp-derived THC) can be lawfully extracted and used in products.
Legal Delta 9 THC and Federal Law
As mentioned, legal delta 9 THC comes from hemp with a THC concentration of no more than 0.3.%. To be lawfully used, hemp-derived THC must be present in the product in less than 0.3% by dry weight.
The legal status of delta 9 on a federal level is actually less complicated than CBD’s. Because CBD is an approved ingredient in medication for epilepsy, it cannot be used in food products (drug exclusion rule). That’s not the case with THC, which, if derived from hemp, can be freely used in a concentration of no more than 0.3%.
Its legality goes back to the 2018 Farm Bill, which removed ‘THC in hemp’ from the list of controlled substances. Retailers can now lawfully offer low THC gummies (up to 10mg) while being aware of the CBD restrictions federally. The FDA tolerates CBD food products if they are not marketed under health claims (as in “it can cure such and such disease”) or dietary supplements.
The Farm Bill defines hemp as:
“The plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].”
That said, marijuana (high THC content) continues to be illegal under federal law. Accordingly, THC extracted from marijuana is also considered illegal.
