What is Hemp-Derived Delta 9 THC?

As you may already know, delta 9 can be derived from both cannabis varieties hemp and marijuana. These two varieties are not equally legal because only hemp was legalized on a federal level under the 2018 Farm Bill. In addition, delta 9 THC derived from legal hemp is not prohibited if present in a concentration of no more than 0.3%.

Regardless if derived from hemp or marijuana, THC has the ability to get you intoxicated. But research shows that there’s more to THC than its intoxicating properties. This compound can be used for pain, inflammation, lack of sleep, nausea, and vomiting. If combined with CBD, it’s a great way to enhance experiences like creating art, listening to music, and sports.

Legal Delta 9 THC and Federal Law

Legal delta 9 THC comes from hemp the federally approved cannabis variety that produces less than 0.3% THC. Because hemp is not intoxicating, the 2018 Farm Bill legalized its production and distribution.

The bill removed the plant from the list of controlled substances, where it was classified with marijuana and other drugs with no accepted medical use. The Farm Bill defined hemp as

“The plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].”

The definition of hemp doesn’t include marijuana which is illegal cannabis with over 0.3% THC. Therefore, when derived from hemp as opposed to marijuana, delta 9 is considered legal — as are the new THC gummies. That is, if they contain less than 0.3% delta 9 THC

The Farm Bill authorized the Food and Drug Administration (FDA) to regulate CBD in food products such as these gummies. While THC is legal federally (under those specific requirements), there’s an issue with using CBD as food or dietary supplement because CBD is an approved epilepsy drug.

The FDA still hasn’t regulated CBD in food products due to a lack of scientific studies on the topic. Regardless, gummies infused with CBD/THC combo are readily available online and in stores because they are not marketed as dietary supplements or under health claims.
