After the enactment of the 2018 Farm Bill, the Oklahoma legislature passed the Oklahoma Agricultural Hemp Pilot Program. Later in 2019, the state passed SB 868, establishing licensing requirements for hemp growers and processors. 

Under Oklahoma’s law, dispensaries (or any entity) selling CBD must be licensed as a food establishment, regardless of the type of product being sold. In addition, establishments (including food stores) may sell pre-packaged CBD products and can’t permit consumption onsite.

What is Hemp-Derived Delta 9 THC?

Delta 9 THC is a psychotropic chemical compound associated with the cannabis “high.” It’s found in both hemp and marijuana but in different concentrations. In hemp, it’s present in less than 0.3%, which is the federally allowed limit. When derived from legal hemp flowers and infused in products in a concentration of less than 0.3%, delta 9 is also considered legal.

Marijuana is high in THC and is still a Schedule I substance. As a result, delta 9 extracted from marijuana is also federally illegal. A product infused with delta 9 can make up no more than 0.3% by dry weight.

The Farm Bill appointed the federal agency to regulate adding CBD into food and beverages.
