Maine allows the sale, use and possession of cannabinoid-infused edibles with less than 0.3% THC despite federal law.

The state legalized the cultivation of hemp back in 2009 under LD 1159. To match federal law and the Farm Bill, Maine passed additional legislation (LD 630) in February 2019. This law regulated the licensing and sale of hemp and hemp-derived products. 

The bill aligns the state definition of hemp with the federal one and considers hemp legal if it contains delta 9 THC concentration of no more than 0.3%. In Maine, foods and food products with CBD or hemp cannot be sold under therapeutic claims.

To be sold in the state, products containing CBD must meet specific labeling standards. In general, labels must include ingredients and details on the manufacturers and exclude any health claims. 

Maine legalized adult-use cannabis in 2016 under the Marijuana Legalization Act. In 2019, Governor Mills signed LD 719 to set up a framework for the sale of adult-use cannabis, which became available for sale in 2020.   

What is Hemp-Derived Delta 9 THC?

Hemp Compliant Delta 9 THC and Federal Law

The 2018 Farm Bill that legalized hemp cultivation and removed hemp from the definition of marijuana. The bill created a legal threshold of 0.3% as the maximum allowed level of delta 9 THC in hemp. This threshold is the main distinguisher between legal hemp and illegal marijuana plants.

The bill also excluded “THC in hemp” from the definition of marijuana and the list of controlled substances. This change in the law allowed the appearance and potentially legal sales of many hemp-derived THC products, including the new delta 9 THC gummies. The new law defines hemp as:

“The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].”

Therefore, cannabinoids like delta 9 are legal when derived from hemp and contained in a concentration of less than 0.3%. But they are illegal if derived from marijuana. Regarding the legality of cannabinoids on a federal level, the Food and Drug Administration was granted authority by the Farm Bill to regulate CBD’s labeling, therapeutic claims, and use as a food additive. 

The FDA has yet to take action and address these issues. As the FDA is finalizing its views on the matter, states stepped forward and approached the issue by setting up their own rules and regulations.
