Rhode Island is one of the states where state law prohibits delta 8 THC derived from hemp. The state classifies all tetrahydrocannabinols and its isomers as Schedule I controlled substances. This means that hemp-derived D8 THC is not legal in Rhode Island.

What is Delta 8 THC? 

Delta 8 THC is a mildly psychoactive cannabinoid naturally present in the hemp plant in trace amounts (less than 0.1%). Compared to its “sister” molecule, delta 9 THC, D8 is less potent and creates a more clear-headed high. Research shows that delta 8 is roughly half to one-third of the potency of delta 9 THC.

Delta 8 THC and Federal Law

All of these compounds naturally found in the hemp plant fall under the definition of “hemp” and are excluded from the definition of “marijuana.” Hemp is no longer a controlled substance federally, meaning hemp-derived products can be legally sold across the U.S. 

But, in early fall, the DEA issued an “Interim Final Rule,” declaring that “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.” The Rule brought confusion within the industry because D8 was booming at the moment, and as we all know, it’s not extracted directly from the hemp plant but converted from CBD. 

Also, federal law doesn’t explicitly define the term “synthetically derived tetrahydrocannabinols,” which puts D8 at risk of being considered a “synthetic” cannabinoid by the feds. The debatable part is whether D8 derived from hemp is a “synthetic” cannabinoid, considering that synthetic cannabinoids are made in a lab from non-organic sources and are dangerous drugs. 

D8 THC products meant for human consumption also require regulatory measures by the FDA. The 2018 Farm Bill granted authority to the FDA to regulate cannabis derivatives under the federal Food, Drug, and Cosmetic Act.
