The reselling of hemp remains unregulated on a federal level. The Food and Drug Administration (FDA) is still in the process of providing a much needed and requested framework for businesses in the industry. Despite hemp being a legal crop for the past two years, both federal and state law are stalling as growers and processors are actively seeking answers. As of this writing, the sale of hemp CBD in food is illegal federally, and companies are not allowed to market their hemp CBD products under medical claims or as dietary supplements.
After the passage of the United States Department of Agriculture (USDA) interim hemp rule, states are required to start testing their hemp crops for the total THC content. In Minnesota, an inspector from the Department of Agriculture must sample each licensed field of growing facility within 30 days of harvest. The sample must be tested on the total potential THC post-decarboxylation, which is calculated as delta-9 THC + (THCA x 0.877). If a crop tests over the allowed 0.3% total THC threshold, it must be destroyed [1].

Edible cannabinoid product also must not contain more than 5 mg of any and all THC cannabinoids per serving and more than 50 mg per package.
