The United States Department of Agriculture (USDA) regulates the cultivation of the hemp plant on a federal level. The USDA recently passed an Interim Rule, which set requirements for THC testing, among other things.
The Rule became effective upon release and requires states to test hemp for total THC levels — the sum of delta-9 THC and the potential conversion of THCA into THC, on a dry weight basis.
If the plants test over 0.3% total THC, they are considered “hot” and must not be used or sold by farmers. Hawaii’s pilot program also requires testing for total THC levels.
Also, the Food and Drug Administration (FDA) is working on regulating hemp CBD products, but the main emphasis, for now, is adding CBD to food and dietary supplements. As of this writing, the FDA is still investigating the impact of hemp smokables on people.
