Ohio is among the very first three states to win approval on its hemp plan by the USDA. The state is in the process of implementing the new hemp plan under the 2018 Farm Bill and regulating the cultivation of hemp and the processing of hemp-derived CBD products.
Does Ohio law authorize the sale of hemp CBD products? Is full spectrum CBD oil (PCR hemp oil) legal to buy in the Buckeye state? Let’s take a look.
Is Full Spectrum CBD (PCR Hemp Oil) Legal in Ohio?
Full spectrum CBD oil can be lawfully sold and bought in Ohio. In July 2019, Ohio Governor Mike DeWine signed a measure into law (Senate Bill 57), which authorizes the sales of CBD outside of dispensaries. The law took effect immediately and made CBD legal in Ohio beyond medical dispensaries. The new law doesn’t require retailers to obtain a license to sell hemp products. But the products need to meet Ohio’s food safety standards and be inspected by a local or state agency.
In the Buckeye state, a hemp product means “any product, containing a delta-9 tetrahydrocannabinol concentration of not more than three-tenths of a percent, that is made with hemp.” Furthermore, “hemp product” includes hemp buds, flowers, cigarettes, cigars, shredded hemp, cosmetics, personal care products, dietary supplements or food intended for animal or human consumption, cloth, cordage, fiber, fuel, paint, paper, particleboard, and any other product containing one or more cannabinoids derived from hemp, including cannabidiol.
The Ohio Board of Pharmacy issued an update on its previous position regarding the sales of hemp CBD products in medical dispensaries. The update is based on the new Ohio law (SB 57) that excluded hemp with a THC concentration of no more than 0.3% from the definition of marijuana. According to the Ohio Board of Pharmacy, “hemp products, including hemp-derived CBD (cannabidiol), can now be sold outside of a licensed medical marijuana dispensary.”
Ohio was among the first three states to win approval on its hemp plan by the USDA.
The Ohio Department of Agriculture is in charge of issuing cultivation licenses, which in this state, last up to three years before requiring renewal. The state kept the application window open until May 1 to accommodate the 2020 growing season.
The Ohio Department of Agriculture has regulatory authority over hemp cultivation and processing. The Department also has the authority to select random hemp products manufactured outside of Ohio to be tested and verified for agreement with THC potency, pesticides, and labeling requirements. Ohio law requires products to be tested for total THC, defined as (THC + (THCA * .877).
Under Ohio law, hemp means “the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis.”
