Is Full Spectrum CBD (PCR Hemp Oil) Legal in New Mexico?
New Mexico has a friendly attitude towards hemp CBD products.
While working on the state Final Rules, the New Mexico Environment Department issued “Emergency Rules” to regulate hemp CBD products following the enactment of the state hemp bill (HB 581).
The Hemp Final Rule has been effective since January 28, 2020, and regulates the process of getting a permit to operate a hemp facility for the production of hemp products.
The Hemp Final Rule defines “hemp extract” as “oil and extracts, including cannabidiol, cannabidiolic acid, and other identified and non-identified compounds from hemp.”
The Rule also permits the sale of “hemp finished product” defined as “a hemp product that is intended for retail sale and containing hemp or hemp extracts for human consumption, absorption, or inhalation that has a THC concentration of not more than three-tenths on one percent (0.30%).”
It seems that the state has aligned its rules with the FDA’s policy on adding CBD to food and food products. The state’s final rules removed “food and food additives” that were initially mentioned in the “Emergency Rules.”
The New Mexico Environment Department’s Environmental Health Bureau (NMED) is in charge of issuing permits for hemp warehouses, extraction facilities, manufacturing and processing facilities.
The state doesn’t require individuals to obtain a permit to sell pre-packaged CBD or other hemp products. But, the state recommends that the pre-packaged products come from a licensed business by a proper state authority.
The New Mexico Final Hemp Rules include various labeling and testing requirements that hemp finished products must comply with before being transported, distributed, or sold to consumers.

The Mr. Hemp Flower Difference
We don’t offer regular CBD oil. Our PCR hemp oil contains the entire hemp plant profile — a diverse range of phytocannabinoids, terpenes, proteins, fatty acids, and vitamins.
According to the theory of the “entourage effect,” when people consume all hemp components together, rather than separately, they benefit more.
When consumed through products such as smokable hemp or whole-plant CBD oil (PCR hemp oil), the hemp components work in synergy, which is more beneficial for the user’s well-being.
Made in the USA
Our full spectrum CBD oil is made in the USA. We manufacture our own full spectrum CBD oil from clean, tested hemp — grown and sourced directly from US licensed farmers. The hemp plants used for extraction are grown in Oregon, Washington State, and Colorado.
We test both the products and the hemp used to make the products. We offer a pure PCR hemp oil made from pesticide-free, non-GMO, toxin-free hemp. The hemp plants used for extraction and the CBD oil are tested by an independent, third-party lab and come with a Certificate of Analysis.
Is It Legal to Ship PCR Hemp Oil to New Mexico?
New Mexico’s Hemp Final Rule regulates the transportation of hemp products in the state. Under the rules, “hemp products” means hemp, hemp-derived material, hemp extract, and hemp finished product.
The state provides for hemp facilities to transport hemp products to licensed hemp facilities or persons approved by a regulatory authority.
The hemp facility shall create and utilize hemp transportation manifest to transport hemp products. The transportation manifest shall contain various information such as a permit, shipping date, facility name, address, and more.
The rules do not include shipping of “hemp finished product” directly to consumers. But, the USPS allows manufacturers to mail small quantities of hemp CBD products directly to consumers. The products have to be made by a licensed manufacturer, contain less than 0.3% THC, and comply with state and federal laws.
