California hasn’t implemented a law that explicitly bans the processing, sale, or consumption of hemp CBD. But, it also hasn’t allowed its lawful use. 

California’s hemp CBD regulations are based on federal law, so the processing and sale of PCR hemp oil are in a gray area in this state. 

According to a 2018 document released by the California Department of Public Health, hemp CBD can’t be lawfully added to foods or dietary supplements. Companies are not allowed to market CBD products under medical claims. The document didn’t provide regulations for other CBD products, such as cosmetics, smokable hemp, or vapes.

On October 14, 2019, California Gov. Gavin Newsom signed Senate Bill (SB) 153. The bill merges the state’s hemp laws with the 2018 Farm Bill. 

The measure takes effect on January 1, 2020, and requires the California Department of Food and Agriculture to develop and submit a hemp plan to the USDA before May 1, 2020. [2]

The new law updates the state’s definition of industrial hemp, which means an agricultural product, whether growing or not, that is limited to types of the plant Cannabis sativa L. and any part of that plant, including the seeds of the plant and all derivatives, extracts, the resin extracted from any part of the plant, cannabinoids, isomers, acids, salts, and salts of isomers, with a delta-9 tetrahydrocannabinol concentration of no more than 0.3 percent on a dry weight basis.”

Marijuana products (THC levels higher than 0.3%) are legally sold in the Golden State. But, state cannabis agencies don’t allow marijuana businesses to use hemp CBD in their products (less than 0.3% THC).
