Under HB 1415, Arkansas Code states that all THC materials created “independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis” are scheduled substances.
So if it was a THC material, it would have been considered illegal under this provision. Although this cannabinoid is not the same as THC, it is a THC isomer commonly derived in a lab through organic synthesis (a sub-category of chemical synthesis) in large quantities.
The law also considers “synthetic substances, derivatives, and their isomers…” as illegal. Under this provision, HHC might be deemed unlawful because it’s chemically converted from another substance.
Therefore, delta 8’s fate awaits HHC in Arkansas if deemed a synthetic substance.
