Under Texas law, “hemp” means the plant Cannabis sativa L. and any part of that plant, including the seeds of the plant and all derivatives, extracts, cannabinoids, isomers, acids, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis. Under the new law,  products intended for ingestion which contain CBD are considered foods and are not controlled substances or adulterated products. 

Every consumable hemp product needs to be labeled in a certain manner before being distributed or sold, and include a batch identification number, name of product’s manufacturer, etc. The regulation of CBD products falls under the Food and Drug Administration (FDA) guidelines and the oversight of the Texas Department of State Health Services (DSHS). 

Although it’s legal to sell consumable hemp products at retail, the state doesn’t allow the manufacturing of these products until the state hemp plan gets approved by the USDA.
