Things weren’t easy for Oklahoma farmers and manufacturers interested in growing hemp. In April 2019 — the same week when the Sooner State legalized hemp — an Oklahoma hemp company filed a lawsuit against the state’s Farm Service Agency director.
Allegedly, the director was misleading farmers about the legality of the hemp plant — which kept them from participating in the state’s industrial hemp pilot program.
Regardless, the state created the Oklahoma Industrial Hemp Program that requires setting up rules for the 2020 growing season. Does that mean hemp flower is legal in Oklahoma? Can you legally buy CBD in this state? Let’s take a look at Oklahoma hemp state laws.
Is Hemp Flower Legal in Oklahoma?
Hemp flower is legal in Oklahoma. In April 2019, Governor Kevin Stitt’s signature advanced the hemp bill from a pilot project to full commercial production under the 2018 Farm Bill.
Under the law “industrial hemp” means the plant Cannabis sativa L. and any part of the plant, including the seeds thereof, and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than three-tenths of one percent (0.3%) on a dry-weight basis.”
The state’s pilot research program remains for the 2019 season, while state officials draft hemp rules for the 2020 commercial production season.

Avoid smoking Hemp in Public
After the 2018 Farm Bill, hemp is no longer a controlled substance in the U.S. But, you should still avoid using hemp smokables in public.
Hemp resembles marijuana, which is illegal in Oklahoma. Law enforcement doesn’t have a field test to determine the difference between hemp and marijuana. So, if you get caught, they will enforce marijuana on you.
Oklahoma Industrial Hemp Program
The Oklahoma Industrial Hemp Program authorizes licensed individuals to engage in the growth, cultivation, handling, or processing of industrial hemp. Individuals are required to apply to the Oklahoma Department of Agriculture, Food, and Forestry for a license prior to planting, handling, or processing the industrial hemp.
The Oklahoma Department of Agriculture estimates a boost in industrial hemp planted for the 2019 season — about three times more than the 2018 season.
Is CBD Legal in Oklahoma?
Yes, it is legal to possess and sell hemp-derived CBD with less than 0.3% THC in Oklahoma. The state decriminalized hemp-derived cannabidiol, making retail sales of industrial hemp and hemp products possible without a license.
Oklahoma Governor, Kevin Stitt signed the bill in May 2019 (went into effect November 1) despite ongoing FDA prohibition on CBD. Of course, all of the CBD products offered to consumers need to come from hemp grown and cultivated legally in both Oklahoma and other states. The products and hemp used need to meet the same or substantially the same requirements for processing and grown hemp.
Also, the bill allows adding hemp-derived cannabidiol to cosmetics, personal care products, and products intended for human or animal consumption. The production and sale of hemp-derived CBD product are allowed without a license and is not considered an adulteration.
