Under the law, “‘hemp’ means the plant Cannabis sativa L. and any part of such plant, including the viable seeds of such plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannbinol concentration of not more than 0.3 percent on a dry weight basis.” 
“Hemp shall be considered an agricultural commodity. Notwithstanding any other provision of law, hemp shall not be considered a controlled substance under the Uniform Controlled Substances Act,” states the law.
Nebraska is among the first states to win federal approval by the USDA for its plan to regulate hemp.
The goal of the plan is to “provide for the monitoring and regulation of hemp production.” 
The hemp plan follows Nebraska’s Legislative Bill 657 — signed by the Governor in May 2019 — and complies with the 2018 Farm Bill and the USDA’s interim rules.
Although the state authorizes hemp production, the legal status of “hemp products” is up in the air.
Nebraska’s LB 657 allows “the possession, transportation, sale, and purchase of lawfully produced hemp products” for commercial purposes, but doesn’t define the term “hemp products.”
Also, the state Department of Agriculture is not in charge of regulating “marketable hemp products.”
