Kansas approved more than 5,000 acres for growing hemp for research and development purposes in 2019. But, where does the Sunflower State stand regarding commercial hemp cultivation and hemp flower?
Is Hemp Flower Legal in Kansas?
Hemp flower is legal in Kansas and can only be sold, distributed, or marketed by a person licensed under the commercial state plan. That being said, the state is still in the process of preparing a state hemp plan and issuing commercial hemp licenses.
Under the commercial industrial hemp act, hemp is defined as “all parts and varieties of the plant Cannabis sativa L., whether growing or not, that contain a delta-9 tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis.”
In the act, the state clarified which products are allowed to be manufactured, marketed, sold, or distributed in the state of Kansas. This is where Kansas prohibits any person that is not licensed under the commercial state plan to market, sell, or distribute:
Ground industrial hemp floral material
Ground industrial hemp leaf material
The state completely prohibited hemp cigarettes, cigars, teas, liquids and solids or any other product intended for human or animal consumption. Kansas is in the process of creating a state hemp plan that will be submitted to the U.S. Department of Agriculture for the commercial production of industrial hemp.

Can You Grow Hemp in Kansas?
Kansas legalized hemp in April 2018, after Governor Colyer signed Senate Bill 263 and is still in the process of issuing commercial licenses. For now, the bill enacted the Alternative Crop Research Act, under the 2014 Farm Bill, which allowed the cultivation of industrial hemp in a research program. So, for 2019, the state has started growing small, highly controlled, plots of industrial hemp only at research facilities.
Under the act, “industrial hemp” means all parts and varieties of the plant Cannabis sativa L., cultivated or possessed by a state educational institution of the department, whether growing or not, that contain a delta-9 tetrahydrocannabinol concentration of no more than 0.3% on a dry weight basis.
Kansas will allow commercial cultivation in 2020, after the approval of the state hemp plan by the USDA.
Is CBD Legal in Kansas?
Kansas is one of the states on the narrow list of states that have the most restrictive laws against CBD. The Sunflower State legalized CBD in 2018, allowing vendors to sell CBD products without THC. In 2019, the state passed a bill that supported the industrial hemp program in Kansas which tweaked the use of hemp in the state. This made most retailers believe that full-spectrum CBD (which by definition contains THC) is legal in this state.
However, a high-level official from the Kansas Bureau of Investigation posted a statement that full-spectrum CBD is not legal in Kansas. In the statement, the official clarified that only pure CBD sold as CBD isolate that doesn’t contain any controlled substances (THC) is legal in this state.
