The bill excludes hemp from the definition of marijuana and adds that hemp and hemp products are presently legal to possess or own. 

Illinois legalized hemp for commercial purposes even before the 2018 Farm Bill was passed. The former Governor Bruce Rauner signed the state’s Industrial Hemp Act, which legalized the growth of hemp. 

At that point, more than 10 other states have legalized industrial hemp. The 2018 Farm Bill was passed in December, paving the way for Illinois and other states to transport and sell their hemp products in other states.

2018—Senate Bill 2298

This bill created the Industrial Hemp Act in Illinois. The bill was signed into law by Gov. Rauner on August 26th and allowed farmers to grow, cultivate, or process industrial hemp products by getting a license issued by the Department of Agriculture [2].

2017—Senate Bill 1294

This bill created the Industrial Hemp Act allowing any person to grow, process, harvest, possess, sell, or purchase hemp [3].
