Chapter 443 of the Texas Health & Safety Code (HB 1325) allows the sale of “consumable hemp products” with less than 0.3% delta 9 THC. This bill passed during the 86th Regular Session and was signed into law on June 10, 2019, regulating the growth of hemp and the sale of hemp products.
Unlike other states, Texas has regulated the manufacture, distribution, and sale of consumable hemp products. It requires both retailers and manufacturers to be registered with the state before making or altering these products.

What is Hemp-Derived Delta 9 THC?
The two main varieties of Cannabis sativa are hemp and marijuana. The Farm Bill of 2018 legalized hemp and its cannabinoids for commercial purposes — including delta 9 THC in a concentration of no more than 0.3% by weight. Marijuana remains a controlled substance on a federal level, as does THC extracted from high THC cannabis.
The legal status of THC depends on the source of extraction (legal hemp vs. marijuana). But, when it comes to its effects, THC is THC regardless of the source. Legal Delta 9 THC and Federal Law
Thanks to the Farm Bill of 2018, delta 9 THC extracted from hemp is a legal substance. Both in hemp and hemp-derived products that are lawfully sold in the U.S., the delta 9 must be present in a concentration of no more than 0.3%.
The bill also removed ‘THC in hemp’ from the list of controlled substances. It defined hemp as:
“The plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].”
The Farm Bill makes a distinction between hemp with less than 0.3% and marijuana with high THC content. Because marijuana is an illegal substance, THC derived from marijuana is also illegal — except in states that have legalized it for recreational purposes.

Consumable CBD products are a greater point of discussion federally because CBD is an already approved epilepsy drug by the Food and Drug Administration. So, under the drug exclusion rule, once a substance is the active ingredient of an approved new drug, a food containing that substance cannot be shipped in interstate commerce.
The Farm Bill authorized the FDA to regulate the use of CBD in consumable products. Years later, the FDA rejected the lawful use of this cannabinoid in food and dietary supplements due to a lack of research. However, CBD products are readily available in all 50 states because the FDA tolerates their sale as long as they are not marketed under health claims.
