Montana has accepted the FDA’s position regarding CBD in food, beverages, and dietary supplements. The state doesn’t allow the sale of CBD in food. 

According to a public letter by the Montana Department of Public Health and Human Services released in July 2019, CBD is prohibited from being used as a dietary supplement or a food additive.

But, the state allows the sale of prepackaged CBD products manufactured outside Montana that are already in commerce, as long as they are not marketed as food.

The state legalized hemp in May 2019 when Senate Bill 176 was signed into law. The bill authorized the Montana Department of Agriculture to develop a state program. While the state doesn’t have specific legislation regarding its position on CBD, statements from state agencies provide some guidelines.

What is Hemp-Derived Delta 9 THC?

The cannabis plant houses over 100 chemical compounds known as cannabinoids and delta 9 THC is a prevalent one. It’s the main intoxicating cannabinoid in marijuana, the cannabis variety that gets users “high.” In hemp, it’s present in less than 0.3%, which is the federal threshold set by the Farm Bill. 

When extracted from the buds and flowers of federally compliant hemp, delta 9 is a legal compound. In the body, delta 9 attaches to the cannabinoid receptors found through the brain and the nervous system. People use it for various ailments, including inflammation, insomnia, migraines, nausea, pain, etc. 

Legal Delta 9 THC and Federal Law

“The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].”

Hemp was legalized as a non-intoxicating plant, but here we have gummies that are slightly intoxicating. Admittedly, this is one of the things that legislators may have overlooked when they legalized hemp. 

A persistent roadblock is that the FDA hasn’t approved the use of cannabidiol (CBD) in food and beverages. The FDA does tolerate the sale of CBD in foods (like our gummies) if the product is not marketed under health claims or a dietary supplement. Regardless, as long as the product contains less than 0.3% delta 9, it’s legal on a federal level.
