Therefore, the new delta 9 gummies are legal because they are a hemp-derived full spectrum product that doesn’t exceed the THC threshold set by federal law. The bill defines hemp as: 

“The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].”

The primary idea behind the legalization of this plant and its cannabinoids was to set a THC limit on products so that they are not considered marijuana. Admittedly, the new hemp-THC products go against the grain and push the boundaries between the hemp and marijuana plant.    

One of the industry’s main issues is the legal status of CBD products. The Food and Drug Administration (FDA) has yet to approve or ban the sale of cannabidiol (CBD) in food and beverages.
