Alabama Delta 9 THC Laws
Hemp-derived products with less than 0.3% THC are legal in Alabama. Although the state’s hemp law is pretty vague, Alabama legalized hemp in 2019 under SB 225. This bill removed hemp from the list of controlled substances and legalized the sale, use, and possession of hemp-derived products.
After the 2018 Farm Bill the office of Alabama Attorney General Steve Marshall, issued a public notice. In it, they affirmed the legality of CBD products with less than 0.3% THC concentration by weight. In 2019, Governor Ivey signed Senate Bill 225, which allowed state pharmacies to redistribute CBD products.
Prior to this, the state passed Carly’s Law and Leni’s Law, both granting protection to individuals who use CBD for debilitating conditions, especially epilepsy.
After the 2014 Farm Bill, the state passed the 2016 Alabama Industrial Hemp Research Program Act, which tasked the state’s Department of Agriculture and Industries to create and establish a program for industrial hemp production. Like other states, Alabama has its own licensing and testing requirements.

Federal law removed hemp from the Controlled Substances Act

The 2018 Farm Bill legalized hemp for commercial purposes and removed “THC in hemp” and “hemp” from the Controlled Substances Act. Under the bill, hemp is defined as:

Federal law defines hemp broadly, legalizing all extracts, cannabinoids, and derivatives, which leaves space for the appearance of different types of hemp products. States have regulated the plant separately but in compliance with the federal limits of delta 9 THC.
